O direito ao meio ambiente equilibrado é assegurado a todos através de disposição constitucional no art. 225. Para se detalhar melhor o tema, verificará a amplitude e a essencialidade do meio ambiente, observando que este é constituído de diversos aspectos que não se resumem apenas ao meio ambiente natural. Por meio da análise principiológica ambiental, serão analisadas as diretrizes do Direito ambiental que norteiam todo o sistema de garantia ao direito fundamental ao meio ambiente ecologicamente equilibrado, principalmente no que se refere à responsabilização civil por danos ambientais como meio de desacelerar a degradação. Após análise da responsabilidade civil, bem como das teorias justificantes das diversas modalidades de sanção civil, é importante conhecer os diversos instrumentos possíveis de correção das externalidades negativas advindas da atuação dos agentes econômicos. Também serão analisados os diversos instrumentos processuais disponíveis para que a atuação do Poder Judiciário seja eficiente diante da falha do Poder Público de agir preventivamente contra o dano ambiental. O objetivo geral da pesquisa é compreender como a responsabilidade civil ambiental, juntamente com políticas públicas e judiciais, podem e devem ser determinantes para o estabelecimento de instrumentos de correção de externalidades negativas no meio ambiente.
