Excerpt from Reports of Cases at Law and in Chancery, Vol. 76: Argued and Determined in the Supreme Court of Illinois; Containing a Portion of the Cases Submitted at the January Term, 1875 The 34th section of the road law of 1873, p. 158, for coun ties not under township organization, provides that county courts which adopt the system Of keeping up their roads by taxes in part and labor in part, shall fix the number Of days each able bodied man between the ages Of twenty-one and fifty, not exceeding three, shall perform on the public roads within the county during the year. And the 39th section of the same act provides, that in any city or town which shall be incorporated under a general or special law, no requisition in labor or money from the citizens thereof on property within the corporate limits shall be required, to improve roads in the county, different from the grant in the charter; but they shall be required to work and pay a tax to improve the streets and roads, and such improvements as shall be required by the charter or within the limits of the corporation, SO long as the charter remains in force. The 29th section of the same law requires the county commissioners to lay out and divide their respective counties into such road districts as they may deem convenient and proper. Excerpt from Reports of Cases at Law and in Chancery, Vol. 69: Argued and Determined in the Supreme Court of Illinois; Containing Additional Cases Submitted at the September Term, 1873 This is a writ of error to the circuit court of Bureau county, to bring up the record of a judgment rendered in that court on appeal from the county court of that county in an information filed by the State's Attorney, on behalf of the People, against Michael Higgins, for an alleged violation of the act of January 13, 1872, known as the liquor law. All the constitutional questions raised on this record were discussed and decided by this court in the case of Myers v. The People, 67 III. 503, and five other similar cases, all decided, against the plaintiffs in error by affirming the judgments of the circuit court. We have no desire to go over the ground explored in those cases, and will confine ourselves to the points now made. It is claimed by the plaintiff in error that the information is defective in not alleging the liquors sold were intoxica ting liquors. This objection has no foundation in fact. The information charges that defendant, not having a legal license to keep a grocery, sold a certain quantity of intoxicating liquors, to be drunk upon or about the building or premises where sold.
