The Laidlaw Inquiry investigated the Department for Transport (DfT) handling of the competition to run passenger trains on the West Coast main line, which was cancelled following the discovery of significant technical flaws in the way the InterCity West Coast franchise process was conducted. It finds that, in seeking to run a complex and novel franchising competition process, an accumulation of significant errors resulted in a flawed subordinated loan facility (SLF) process. (This is the process where the DfT addresses the risk posed by the thinly capitalised nature of the bidders, requiring commitments from the owning groups for an SLF.) The responsibility for this flawed process lies with the Dft rather than with any of its external advisers. Chapters include: scope and work undertaken; the course of events in relation to the SLF sizing process; findings concerning the GDP resilience model; external advisers; contributory factors; lessons to be learned and recommendations. The Inquiry produces a number of specific recommendations on: inadequate planning and preparation; deficiencies in organisational structure and resourcing; lack of efficacy in governance framework. Improvements in quality assurance procedures are essential. Rapid implementation of the recommendations should help to restore confidence in the DfT's ability to conduct effective railway franchising and procurement.

Embarking on an ambitious, perhaps unachievable, reform of rail franchising, in haste, on the UK's most complex piece of railway was irresponsible. Many of the problems with the franchise competition, detailed in the Laidlaw report, reflect very badly on civil servants at the DfT. Public service contracts with the private sector need to deliver good quality services and value-for-money for the taxpayer. Select Committees scrutinising the work of departments across Government have found that, on too many occasions, the Civil Service has failed to design effective contracts or to monitor contracts adequately. This report has collated this evidence and demonstrated that there are systemic failings in Civil Service contract management. We have raised specific concerns about the paucity of commercial skills, and officials feeling unable to speak truth to power. The Committee therefore supports the establishment of a Parliamentary Commission on the Civil Service to examine the capacity, skills and operation of Government departments. The contracts issue demonstrates how significantly the role of the Civil Service has changed since the Northcote-Trevelyan Report set out the principles on which it should operate. A coherent analysis of the state of the Civil Service, and the requirements placed upon it, would help to improve governance across Whitehall, and help to eliminate the contract-management failures seen in recent years

The competition held by the Department for Transport to award a new InterCity West Coast franchise in 2012 was intended to be the first in the most extensive programme of franchising since privatisation. Significant errors were made by the Department during the competition, which not only caused the cancellation of that franchise award at considerable public expense but also called into question the remaining franchising programme. This report is the second of two independent reviews commissioned by the Government, by Richard Brown, the Chairman of Eurostar. It concludes that franchising is a fundamentally sound approach for securing the passenger railway services on which so many people rely. His recommendations include: that the franchising programme should be restarted as soon as possible, but at a pace that both the department and the industry can sustain; that franchise terms should be determined by the circumstances and size of each individual franchise; proposals to strengthen and simplify the bidding and evaluation process for each franchise; proposals for the financial and contractual structure of future franchises, including in relation to risk allocation and capital requirements; and that the government should plan to devolve responsibility for further English franchises to the relevant authorities. Mr Brown also makes recommendations on how to strengthen the department's capability to manage the future franchising programme, echoing the findings of Sam Laidlaw's independent inquiry into the lessons to be learnt from the InterCity West Coast competition. The review also recommends that the Government should determine, by February, plans for the three franchise competitions which were put on hold
