Mrs. Jessie Benton Fremont submitted a claim for restoration or for payment for her property taken by the Army. The US Army designated the area for military use in 1847 and wanted to locate an artillery battery there. The Army denied that Mrs. Fremont had legal title to the land. The matter was sent to the Supreme Court.
