Ewan McKendrick has been an instrumental figure in shaping the law of obligations, both as a practitioner and as a professor at the University of Oxford and University College London. On the occasion of his retirement from the Oxford Law Faculty, this volume presents a collection of essays in his honour. The contributions pay tribute to and reflect the breadth of Ewan McKendrick's scholarship and published work. Many are comparative in nature, reflecting a key element of his work. The volume is divided into four parts: contract, tort, unjust enrichment, and commercial law, with each of the 23 essays discussing a particular complex question or idea in its area. Since Xi Jinping’s accession to power in 2012, nearly every aspect of China’s relations with Africa has grown dramatically. Beijing has increased the share of resources it devotes to African countries, expanding military cooperation, technological investment, and educational and cultural programs as well as extending its political influence. This book examines the full scope of contemporary political and security relations between China and Africa. David H. Shinn and Joshua Eisenman not only explain the specific tactics and methods that Beijing uses to build its strategic relations with African political and military elites but also contextualize and interpret them within China’s larger geostrategy. They argue that the priorities of Chinese leaders—including the conflation of threats to the Communist Party with threats to the country, a growing emphasis on relations in the Global South, and a focus on countering U.S. hegemony—have combined to elevate Africa’s importance among policy makers in Beijing. This book provides a philosophical critique of legal relations between the EU and 'distant strangers' neither located within, nor citizens of, its Member States. Starting with the EU's commitment in Articles 3(5) and 21 TEU to advance democracy, human rights, and the rule of law in 'all its relations with the wider world', Ganesh examines in detail the salient EU and international legal materials and thereafter critiques them in the light of a theory of just global legal relations derived from Kant's philosophy of right. In so doing, Ganesh departs from comparable Kantian scholarship on the EU by centering the discussion not around the essay Toward Perpetual Peace, but around the Doctrine of Right, Kant's final and comprehensive statement of his general theory of law. The book thus sheds light on areas of EU law (EU external relations law, standing to bring judicial review), public international law (jurisdiction, global public goods) and human rights (human rights jurisdiction), and also critiques the widespread identification of the EU as a Kantian federation of peace. In the last few decades, Southeast Asia has become generally more peaceful and more prosperous, with progress in economic development, regional cooperation and integration. ASEAN in particular plays a leading role within and beyond the region in promoting multilateral cooperation in both security and economic matters. All these developments progress amid increasing hegemonic competition between the US and China for regional dominance in the Asia-Pacific region. According to the realist viewpoint of international politics, Southeast Asian states can do nothing but choose sides at the expense of international political autonomy in order to maintain their national interests. Tang argues, however, that in fact there exists an opportunity for Southeast Asian states to simultaneously reinforce their military security, economic development and international political autonomy in face of the US-China hegemonic competition. Drawing on the ideas of power transition theory and recent works of capitalist peace, Tang argues that small states can exploit the competition between great powers to make economic gains and ensure security while maintaining their autonomy. He outlines the necessity of cooperation among these small states and of economic liberalization for the effectiveness of this reinforcing dynamics, applying policy and econometric analyses to a wide range of qualitative and quantitative data.
