Author: Siegfried Lienhard
Publisher: Motilal Banarsidass Publ.
ISBN: 9788120809635
Category : Literature
Languages : en
Pages : 244
Book Description
A productive and highly important branch of Nevari literature is poetry. The songs reflect the thought of the Nevars, their way of life, religious belief, their history and folklore. The greatest possible variety of genres and styles have been included in the present anthology. Most of the songs included, religious hymns as well as folksongs and ballads, are still very popular among Nevars. In order to facilitate reading and consultation, the whole corpus of the songs collected has been grouped into four principle sections, namely Religious Poetry, Songs about Love and Marriage, Epic Poetry, Didactic and Enigmatic Verses. The book contains two appendices. While the first lists the talas and ragas, as they are given in the various anthologies published in Nepal, the Second makes an attempt to transpose two songs into the European system of music. The translations are quite faithful and every effort has been made to preserve the spirit and flavour of the original. Contents Preface, Introduction, Translation, I. Religious Poetry: 1. From Apology to Utopia
Author: Martti Koskenniemi
Publisher: Cambridge University Press
ISBN: 1139447645
Category : Law
Languages : en
Pages : 705
Book Description
This book presents a critical view of international law as an argumentative practice that aims to 'depoliticise' international relations. Drawing from a range of materials, Koskenniemi demonstrates how international law becomes vulnerable to the contrasting criticisms of being either an irrelevant moralist Utopia or a manipulable façade for State interests. He examines the conflicts inherent in international law - sources, sovereignty, 'custom' and 'world order' - and shows how legal discourse about such subjects can be described in terms of a small number of argumentative rules. This book was originally published in English in Finland in 1989 and though it quickly became a classic, it has been out of print for some years. In 2006, Cambridge was proud to reissue this seminal text, together with a freshly written Epilogue in which the author both responds to critiques of the original work, and reflects on the effect and significance of his 'deconstructive' approach today.

The Southern Judicial Tradition
Author: Timothy S. Huebner
Publisher: University of Georgia Press
ISBN: 9780820332369
Category : Law
Languages : en
Pages : 288
Book Description
This first book to examine the lives and work of nineteenth-century southern judges explores the emergence of a southern judiciary and the effects of regional peculiarities and attitudes on legal development. Drawing on the judicial opinions and private correspondence of six chief justices whose careers span both the region and the century, Timothy S. Huebner analyzes their conceptions of their roles and the substance of their opinions related to cases involving homicide, economic development, federalism, and race. Examining judges both on and off the bench--as formulators of law and as citizens whose lives were intertwined with southern values--Huebner reveals the tensions that sometimes arose out of loyalties to sectional principles and national professional consciousness. He exposes the myth of southern leniency in appellate homicide decisions and also shows how the southern judiciary contributed to and reflected larger trends in American legal development. This book adds to our understanding of both southern distinctiveness and American legal culture.

Intellectual Property and Information Control
Author: Adam Moore
Publisher: Routledge
ISBN: 1351512137
Category : Law
Languages : en
Pages : 400
Book Description
Computer technology and the proliferation of digital networks have radically altered how ideas and information are gathered and manipulated and generated new conflicts between public use and private rights. These conflicts raise serious problems: Are abstract ideas and information proper subjects of ownership? What role should privacy rights play? How does the violation of intellectual property rights compare morally to the violation of physical property rights? Now available in paperback, Intellectual Property and Information Control provides answers and strategies for dealing with these and other questions while mounting a philosophical defense of rights to intellectual and intangible property. As the book shows, a policy that allows too much access may stymie innovation and cause individuals to isolate themselves. At the other extreme, huge, multinational corporations may hold as intangible property vast amounts of knowledge, including sensitive personal information. Through discussions of patent law, fair use, and practical problems such as privacy in the workplace, Moore demonstrates that intellectual and intangible property rights exist along with privacy rights. The latter will sometimes constrain what can be done with the former.

Maritime Risk Management
Author: Phillip Hellwege
Publisher: Duncker & Humblot
ISBN: 3428582608
Category : Electronic books
Languages : en
Pages : 305
Book Description
Insurance is a legal, an actuarial and a financial product, and it is one out of many risk management strategies. It follows that its history can only be studied in the broader context of the development of such strategies, applying an interdisciplinary approach. The theme of the present volume is maritime risk management. After an overview over the history of insurance, the contributions to the present volume examine different maritime risk management strategies by adopting a variety of methodological approaches. Some contributions focus on normative provisions, others contrast practice with legal scholarship, or focus on the emergence of insurance companies as opposed to individual insurers. Again, other contributions give insights in marine insurance practice in specific cities or analyse insurance practice through the lens of specific insurance litigation. As to the time frame, the different contributions span from antiquity to the nineteenth century.
