Probate court of Shelby county is a county court, and judge's salary is payable by county. The probate court of Shelby county, created and established by the statute contained in sections 387 to 391, inclusive, of the Code, is unquestionably a county court, and the provision in the statute (Code, sec. 391) that the judge thereof shall be paid out of the county treasury is valid.
