For decades, historians have primarily analyzed charges of black-on-white rape in the South through accounts of lynching or manifestly unfair trial proceedings, suggesting that white southerners invariably responded with extralegal violence and sham trials when white women accused black men of assault. Lisa Lindquist Dorr challenges this view with a careful study of legal records, newspapers, and clemency files from early-twentieth-century Virginia. White Virginians' inflammatory rhetoric, she argues, did not necessarily predict black men's ultimate punishment. While trials were often grand public spectacles at which white men acted to protect white women and to police interracial relationships, Dorr points to cracks in white solidarity across class and gender lines. At the same time, trials and pardon proceedings presented African Americans with opportunities to challenge white racial power. Taken together, these cases uncover a world in which the mandates of segregation did not always hold sway, in which whites and blacks interacted in the most intimate of ways, and in which white women and white men saw their interests in conflict. In Dorr's account, cases of black-on-white rape illuminate the paradoxes at the heart of segregated southern society: the tension between civilization and savagery, the desire for orderly and predictable racial boundaries despite conflicts among whites and relationships across racial boundaries, and the dignity of African Americans in a system dependent on their supposed inferiority. The rhetoric of protecting white women spoke of white supremacy and patriarchy, but its practice revealed the limits of both.

But if he does, our culture suddenly rises up to defend the husband’s actions. By criticizing women for failing to give males the caring, love, attention, mental, emotional, and particularly physical support they need. Among the most horrifying crimes is Marital rape a crime that is committed not only in India but across the entire world. Marital rape is not a lesser crime than rape or we can address it as a subtype of rape. Married women are in most of the cases the greatest victims of marital rape. One of the biggest threats to India’s gender justice system is posed by it. It is one of those societal illnesses that has been in India since ancient times and still has a negative impact on society. Indian society has never had a bad attitude about marital rape. It is rarely opposed by anyone in Indian society for a variety of reasons. The Indian legislative position is similar in this regard. In order to ensure the security, the Indian Constitution has given the Indian government the most arduous task of creating legislation. The security of the country’s overall prosperity in this context is given into the hands of the legislature which is however, is not particularly interested in ending marital rape which it very evident because they tend to delineate an extremely casual approach when it comes to marital rape. Although the Indian judiciary expresses some hope in this regard, it is limited by the fact that the legislature, not the court, is solely in charge of passing laws. There are no effective laws in India yet that will prevent marital rape. Whatever regulations exist in India, they are insufficient to stop a horrible crime like marital rape. India needs to enact some strict legislation to stop marital rape.

This book provides a detailed analysis of Islamic juristic writings on the topic of rape and argues that classical Islamic jurisprudence contained nuanced, substantially divergent doctrines of sexual violation as a punishable crime. The work centers on legal discourses of the first six centuries of Islam, the period during which these discourses reached their classical forms, and chronicles the juristic conflict over whether or not to provide monetary compensation to victims. Along with tracing the emergence and development of this conflict over time, Hina Azam explains evidentiary ramifications of each of the two competing positions, which are examined through debates between the Ḥanafī and Mālikī schools of law. Using affective and feminist materialist approaches to rhetorical criticism, Stephanie Larson examines how discourses about rape and sexual assault rely on strategies of containment, denying the felt experiences of victims and ultimately stalling broader claims for justice. Investigating anti-pornography debates from the 1980s, Violence Against Women Act advocacy materials, sexual assault forensic kits, public performances, and the #MeToo movement, Larson reveals how our language privileges male perspectives and, more deeply, how it is shaped by systems of power—patriarchy, white supremacy, ableism, and heteronormativity. Interrogating how these systems work to propagate masculine commitments to “science” and “hard evidence,” Larson finds that US culture holds a general mistrust of testimony by women, stereotyping it as “emotional.” But she also gives us hope for change, arguing that testimonies grounded in the bodily, material expression of violation are necessary for giving voice to victims of sexual violence and presenting, accurately, the scale of these crimes. Larson makes a case for visceral rhetorics, theorizing them as powerful forms of communication and persuasion.
