Book Description
A complete and well-documented review of contract law in China. This in-depth introduction to the law of contracts of Mainland China was written for Western lawyers who have contacts with the People’s Republic of China, for scholars and students of comparative law or of Sinology. As stated above the book is merely an introduction, not a technical legal treatise for specialised private lawyers. It is therefore useful for businessmen too. Without using stale language, this work also places the law of contractual obligations in an historical and socio-political context. It sketches, besides the general theory of contractual obligations and the provisions on the several specific contracts, the Chinese case law on international sales contracts, as well as the law on the dispute resolution. It can be said that with regard to the private law the book opens a window on the continental Chinese legal culture, as Zweigert and Kötz would call it. An essential handbook for all lawyers who wish to be fully involved in international relationships ABOUT THE AUTHOR Jacques H. Herbots devoted his PhD thesis to African law. Thereafter, for many years he taught contracts, obligations and comparative law at the renowned university of Louvain. Besides his main tasks as a professor, he kept feeling the pulse of the living law as a deputy judge, as an assessor in the Belgian Council of State and as a member of the High Council for the Judiciary. He is currently still arbitrator in the Belgian Centre for Arbitration and Mediation, and he was appointed to the panel of the CIETAC in Beijing. Ever since a visit to the People’s Republic in 1974, one may safely say he has been fascinated by the Empire of the Middle.

Book Description
How have Westerners seen the People's Republic of China over the years? The question raises many important issues, which this book aims to present, analyze and explain. The basic conclusion is that Western perspectives are somewhat more complex than simply viewing China's realities. Involved also are politics and power relations, trends in journalism and scholarship, as well as individual and group personalities and psychologies.Based on extensive personal experiences in China dating back to 1964 and wide-ranging travel in Tibet and ethnic regions since the 1980s, the author attempts to distinguish trends in different Western countries. However, most of the material will concern the United States, which has been the dominant contributor to Western perspectives during the whole period of concern to this book. The perspectives are taken up by topic, including politics, economy, society, and ethnic minorities. Inherent in each topic is the way cultures see and react towards each other. Images and perspectives can affect policy, and have done so many times in the past, which adds to the importance of this book. It also takes up questions of the sources of Western perspectives, both in terms of direct sources, such as newspapers, television or the internet, and deeper ones, such as social values and temperament.

Book Description
This paper presents an assessment of the level of observance of the Insurance Core Principles (ICPs) in China. Overall, the Chinese regulatory system is assessed to have a good level of compliance with the ICPs. The regulatory framework includes, in addition to the solvency standards, extensive requirements on corporate governance, risk management and internal controls as well as on reinsurance, disclosure and conduct of business. All these requirements are applied appropriately to the significant number of large insurance groups, which together account for the bulk of premium income. However, there is scope for further development of crisis preparedness and market conduct work.

Book Description
This book combines empirical research and theoretical discussions to demonstrate that the civil society paradigm as a western concept could be applicable to the study of state-society relations in contemporary China. However, the growth of Chinese civil society does not necessarily present an adversarial or confrontational relationship between state and society, but rather it is a cooperative relationship based on common interests and mutual benefits between industrial associations and local governments. The findings of this research confirm that, in contrast to the conventional civil society model in Western and Eastern Europe, where civic organizations are independent of the state, challenging the state hegemony, Chinese civic organizations, however, still lack autonomy and even remain closely linked to the state, but they are growing and expanding their public space and important role in public affairs through active participation. This non-western path for civil society development is a precise reflection of reality that is profoundly shaped and constrained by Chinese institutional, sociological, and cultural context. Through close investigation into the industrial, organizational, and social governance of industrial associations in Wenzhou and in-depth analysis of their challenges and developments within the institutional context, this book provides fresh empirical evidence and insightful analysis of how industrial associations have actively participated in local industrial governance and conduct of public affairs, gained greater space for their development, and become indispensable partners of local government in social governance.

Book Description
It is a pleasant task to welcome the appearance of the American edition of Professor Willy Kraus' valuable work on the economic and social development of the People's Republic of China, first published in German in 1979. The book has been updated in the light of the events that have occurred since the original publication and incorporates the latest statistical information made available by the Chinese authorities with unaccus tomed liberality. The American edition, like its German predecessor, is a monumental achievement of scholarship, attractively presented. In its comprehensiveness, insight, professionalism and wisdom it ranks among the best studies of the subject. It will add to the knowledge of the specialist, and help the interested layman find his way through the complexities of contemporary China's socioeconomic system. Professor Kraus' work is a most timely and welcome addition to a better and more thorough understanding of an absorbing and important subject. June 1982 Jan S. Prybyla Professor of Economics The Pennsylvania State University University Park, Pennsylvania Preface This book deals with China's development policies. It is based on the original German edition (1979), "Wirtschaftliche Entwicklung und sozialer Wandel in der Volksrepublik China," but is not merely a translation of the German original. The rapid changes in Chinese policy within the last two years, together with a sudden deluge of official data on economic and social developments in the People's Republic of China, have called for a basic and comprehensive revision of text and statistics.
