The aim of the organizers was to show what problems existed during the transition from dictatorship to democracy in several countries around the world. They all enacted laws or other measures to ensure that fundamental rights and the rule of law would resist anti-democratic ideologies, anti-Semitism, racism, and war crimes in the future. However, the legal system and law in these countries themselves often had their origins in dictatorship. Thus, there were and are obvious and hidden anti-democratic continuities that influence law and the legal system up to the present. Scientifics and jurists from Italy, Japan, Poland, Spain, South Africa, and Germany examine these continuities in their contributions.

Presidents of nations with constitutionally imposed term limits are often viewed as growing weaker as they approach the end of their time in office. However, in this important new study, political scientist Genevieve M. Kehoe argues that because such chief executives are free from reelection constraint and often still enthusiastic to create a legacy by pursuing bold projects, they may accomplish significant initiatives. Kehoe has developed a concept for this which she calls “Terminal Logic Behavior” (TLB). Presidents and Terminal Logic Behavior: Term Limits and Executive Action in the United States, Brazil, and Argentina provides both case studies and quantitative evidence to show how US presidents of the last three decades have utilized decrees on foreign, domestic, and environment policy during their final months in office. She finds a systematic pattern of decree use consistent with the mark of TLB in a most unexpected place—presidents’ use of national emergency powers. In a careful comparative analysis, she also finds support for her argument in the Argentinean and Brazilian experience of the same period.

This book combines an institutional political economy approach to policy making with social network analysis of social policy formulation processes. Based on extensive interviews with governmental and nongovernmental actors, the case studies of social policy formulation in Argentina, The Bahamas, Bolivia, and Trinidad and Tobago show that while societal actors are central in the networks in South American countries, government officials are the main participants in the Caribbean countries. The comparative analysis of the networks of ideas, information, economic resources, and political power across these cases indicates that differences in the types of bureaucratic systems and governance structures may explain the diversity of actors with decision power and the resources used to influence social policy formulation across the region. These analytical and methodological contributions-combined with specific examples of policies and programs-will help to enhance the efficiency, efficacy, and sustainability of public policies in the social arena.

Reform success and reform delay are subject to a variety of explanations. In general, high decisiveness leads to reform propensity, while its absence, or high resoluteness, to policy-gridlock. The Brazilian reform experience is contradicting: both aspects are present - factors leading to decisiveness as well as those inducing gridlock and reform delay. Leaving the static point of view and accounting for a dynamic development, this apparent contradiction gets resolved: in fact, the executive gained growing leeway during the 1990s, providing it with the means to achieve a higher degree of decisiveness of the political system by simultaneously guaranteeing resoluteness.It is, however, greatly mistaken to consider this development as a blank cheque to universal, encompassing reforming in all areas. Despite growing executive dominance and growing policy consensus, some particular reforms were a success, while others did not surpass its initial stages. This is finally due to path-dependency and explicit policy-specificities, triggering different institutional constraints and veto-points, which even strong Presidents cannot override.
