Recognizing that successful counterterrorism efforts require effective information sharing, section 1016 of the Intelligence Reform and Terrorism Prevention Act of 2004 (IRTPA) (Public Law 108-458), building on Executive Order 13356 of August 27, 2004, "Strengthening the Sharing of Terrorism Information to Protect Americans" (Executive Order), requires the creation of the "Information Sharing Environment" (Environment) for terrorism information. In accordance with IRTPA, the Environment will be the combination of policies, procedures, and technologies linking, as appropriate, the resources (people, systems, databases, and information) of Federal, State, local, and tribal governments, the private sector, and potentially foreign allies to facilitate information sharing, access, and collaboration among users to combat terrorism more effectively. The Environment will support sharing and access to terrorism information, including information from the intelligence, law enforcement, military, homeland security, and other communities. Consistent with section 1016(f)(1) of IRTPA, the President designated John A. Russack as the Program Manager (PM) for information sharing on April 15, 2005. As recommended by the Commission on the Intelligence Capabilities of the United States Regarding Weapons of Mass Destruction (WMD Commission), by Memorandum of June 2, 2005, the President directed the Director of National Intelligence (DNI) to exercise "authority, direction, and control over the PM." The President also directed the heads of all executive department and agencies to provide assistance and information to the DNI and the PM, which will assist the PM in implementing his government-wide statutory mandate in section 1016. This document is the PM's Preliminary Report.

A breakdown in information sharing was a major factor contributing to the failure to prevent the September 11, 2001, terrorist attacks. Since then, federal, state, and local governments have taken steps to improve sharing. This statement focuses on government efforts to (1) establish the Information Sharing Environment (ISE), a government-wide approach that facilitates the sharing of terrorism-related information; (2) support fusion centers, where states collaborate with federal agencies to improve sharing; (3) provide other support to state and local agencies to enhance sharing; and (4) strengthen use of the terrorist watchlist. GAO's comments are based on products issued from September 2010 through July 2011 and selected updates in September 2011. For the updates, GAO reviewed reports on the status of Department of Homeland Security (DHS) efforts to support fusion centers, and interviewed DHS officials regarding these efforts. This statement also includes preliminary observations based on GAO's ongoing watchlist work. For this work, GAO is analyzing the guidance used by agencies to nominate individuals to the watchlist and agency procedures for screening individuals against the list, and is interviewing relevant officials from law enforcement and intelligence agencies, among other things.

Section 1016 of the Intelligence Reform and Terrorism Prevention Act (IRTPA) calls for improved sharing of terrorism information to support the country's ability to effectively prosecute the counterterrorism (CT) mission. Improved sharing of information allows users to more efficiently and effectively locate, interact and connect the dots. Improvements needed to information sharing include: (1) Eliminate single points of failure; (2) Ensure that information flows not only to senior officials, but also down or laterally to operational entities; (3) Improve support to real-time operations; (4) Increase connectivity and access between users and critical information; and (5) Improve sharing among Federal, State, Local, Tribal (SLT) and private sector (PS) personnel. Additional observations and principles have been developed by CT practitioners that must be addressed in developing the Information Sharing Environment (ISE) include: (1) Integrate systems across Federal, State, Local and Tribal governments; (2) Better manage the complexity of the information flood; (3) Ensure that information sharing tactics are driven by the needs of the information users; and (4) Standardize terminology. As detailed in the IRTPA, a critical function of an effective Information Sharing Environment is an electronic directory service that facilitates personal contact between CT professionals. To begin the process of overcoming the current shortfalls in our CT capability, IRTPA directs the Program Manager, in consultation with the Information Sharing Council (ISC) to: "Establish an initial capability to provide electronic directory services, or the functional equivalent, to assist in locating in the Federal Government intelligence and terrorism information and people with relevant knowledge about intelligence and terrorism information..."

In general, a fusion center is a collaborative effort to detect, prevent, investigate, and respond to criminal and terrorist activity. Recognizing that fusion centers are a mechanism for information sharing, the federal government--including the Program Manager for the Information Sharing Environment (PM-ISE), who has primary responsibility for governmentwide information sharing, the Department of Homeland Security (DHS), and the Department of Justice (DOJ)--is taking steps to partner with fusion centers. This testimony is based on GAO's draft report on state and local fusion centers. It addresses (1) the statutes and characteristics of the centers and (2) to what extent federal efforts help alleviate challenges fusion centers identified. In conducting this work, GAO reviewed center-related documents and conducted interviews with officials from DHS, DOJ, and the PM-ISE, and semistructured interviews with 58 state and local fusion centers.
