Excerpt from Popular Government, Vol. 22: February 1956 It might be well to say a few words about those private streets which remain private streets. As we have seen, whether a street is public depends upon whether it has been dedicated and accepted. As dedication amounts to an offer by the owner of the land, we must look to his intent in order to deter mine whether an offer has in fact been made. Nothing else appearing, when a street is opened up for the use of the public, or when lots ar sold with reference to a plat on which a street appears, most courts will hold such street to have been dedicated. It becomes a public street. When, on the other hand, the owner of such a street takes action showing his ih tention to retain control of the street (such as posting at the entrance thereto a sign marked Private Way) this may indicate that he has no intention of dedicating the street to the public, and it remains private property. Excerpt from Popular Government, Vol. 22: November, 1955 The issue can best be raised with a particular kind of taxpayer or class of taxpayers in mind. I am thinking of those who own property and do business in more than one place, more than one county, more than one town. If the discount pat tern is uniform throughout the state these taxpayers will adjust their business and accounting practices to meet that pattern; if the discount pattern varies from location to loca tion (not to say from one session of the legislature to another) the tax payer must make a series of busi ness and accounting adjustments which, it can be argued with force, place him at a distinct disadvantage. Perhaps the new taxpayer or the one who first meets this situation will feel the discrimination most sharply. So long as the state itself imposes no property tax for administration by local units of government the question of the constitutionality of local variants from the state-wide law runs little risk of judicial testing, but whether they do violence to the spirit if not the letter of the Constitution's uniformity requirement is still a ser ious question for those concerned with law-making in this state. Excerpt from Popular Government, Vol. 22: April 1956 At the appointed time and place the person commissioned by 'the' court to take the deposition, or a notary public, administers the oath to the witness and the examination begins. The party on whose behalf the deposi tion is taken, or his attorney, may question the witness orally or he may submit written questions. In either case, the adverse party or his attorney may cross-examine the witness orally or in writing. In some cases the ques tions and cross-questions are all writ ten and are prepared by the parties or their attorneys in advance of the examination. When this method is used, the examination may be' con ducted by the commissioner or notary alone. During the examination, any objection should be made after the question and before the answer is given. The commissioner or notary should record all such objections but make no ruling thereon. North Carolina was the first state in the nation to take such action, completely relieving the counties and townships of all local roads in 1931. Since that date, the motor vehicle, and not real property, has furnished all the tax revenues for the building, improve ment and upkeep of all local roads. As well as state highways. Second, the state has financed a more expensive program of secondary road improvements than has any other state in recent years. During the five years ending June 30, 1954, the state spent $350 million on this system; and, since 1931, the state has expend ed over $600 million on this system. Both figures include Federal Aid. Sixteen of the cities do not require the developer to post bond or otherwise guarantee completion of the improvements re quired by the subdivision ordinance. Several of the cities, however, refuse to connect city services or accept streets until the improvements are completed. Nine cities require bonds or other guarantees if final approval of the subdivision is given before completion of the improvements. In some cases, the developer may file a petition for the required improvement in place of posting bond. Thus the city does the work and assesses the abutting property.
