Il volume si presenta suddiviso in varie parti rispettivamente dedicate: all’esame specifico dei nuovi meccanismi istituzionali che governano il complesso fenomeno delle ispezioni e della vigilanza in materia di sicurezza sul lavoro alle linee di sviluppo del nuovo apparato sanzionatorio così come individuato dal d.lgs. n. 81/2008 e successivamente modificato dal d.lgs. 106/2009, con particolare riferimento: al procedimento ispettivo e sanzionatorio, amministrativo e penale, ai limiti di applicabilità dei poteri degli organi di vigilanza (prescrizione, disposizione, diffida), alla lettura dell’apparato punitivo fra contravvenzioni e sanzioni amministrative, alla responsabilità diretta dell’ente, alle condizioni di estinzione agevolata dell’illecito, all’esercizio dei diritti della persona offesa all’analisi dell’apparato sanzionatorio e alla puntuale individuazione di tutte le ipotesi sanzionatorie previste dal nuovo testo unico, anche mediante apposite tabelle che individuano: la fattispecie illecita, la reazione punitiva, le forme di estinzione agevolata dell’illecito Infine viene proposta: la normativa e la prassi amministrativa di principale rilievo, accanto alla modulistica riguardante le fasi principali del procedimento sanzionatorio penale e amministrativo.

This book explores the early globalization of prostitution from the perspective of the Italian case. It is a story of prostitution, migration, and work, built through analyses of primary sources (the Italian archive of International Police) and covering a wide chronological period, from the end of the nineteenth century through the Second World War. It is the story of Giuseppa, Virginia, and many others who embarked from Italian ports in the 1890s to work in brothels in Egypt, Libya, and Malta, but also that of Marguerite, one of the numerous foreign prostitutes working in Italy in the 1930s. It is the story of Mariella, forced by her husband Beniamino to work as a prostitute in the United States while pregnant in the 1900s, of Francesco, who on the eve of the Second World War recruited young natives to work in his cabarets in Panama. It is the story of a passionate diplomat committed to the League of Nations’ fight against the white slave traffic but also of police officers, consuls, and ministers more concerned about their nation’s reputation than women’s rights. It is more than a survey, as topic after topic, the reader can get a closer view of approaches and techniques. One aim is to introduce practitioners of AI to the modelling legal evidence. Another aim is to introduce legal professionals, as well as the more technically oriented among law enforcement professionals, or researchers in police science, to information technology resources from which their own respective field stands to benefit. This comparative analysis examines the scope of prosecutorial powers at different phases of criminal investigation in four countries: the United States, Italy, Poland, and Germany. Since in all four the number of criminal cases decided without trial is constantly increasing, criminal investigation has become central in the criminal process. The work asks: who should be in charge of this stage of the process? Prosecutors have gained tremendous powers to influence the outcome of the criminal cases, including powers once reserved for judges. In a system in which the role of the trial is diminishing and the significance of criminal investigation is growing, this book questions whether the prosecutor's powers at the early stage of the process should be enhanced. Using a problem-oriented approach, the book provides a parallel analysis of each country along five possible spheres of prosecutorial engagement: commencing criminal investigation; conducting criminal investigation, undertaking initial charging decisions; imposing coercive measures; and discontinuing criminal investigation.
