Las personas enfermas de los países en vías de desarrollo y menos adelantados no tienen fácil acceso a los medicamentos debido a los derechos exclusivos de que son detentores las industrias farmacéuticas, así como por su alto costo. Tanto la industria farmacéutica como los gobiernos de los países en vías de desarrollo y menos adelantados, tienen el derecho de velar por sus intereses, los cuales deben ser salvaguardados por medio de la legislación internacional, dando a cada uno la protección jurídica necesaria. La presente tesis, trata precisamente sobre el sistema de patentes en farmacéuticos y el acceso a los medicamentos por parte de la población enferma de las personas de los países en vías de desarrollo y menos adelantados. Se analiza la naturaleza jurídica de las patentes, según la legislación internacional y la nacional, en éste ámbito se analizan las recientes reformas a la ley de propiedad industrial y se hacen algunas recomendaciones jurídicas al respecto. Se analiza de igual manera la importancia de las industrias farmacéuticas en el bienestar de la humanidad, sus objetivos, la responsabilidad social que ostentan y los derechos que reclaman. Se estudian también las necesidades de los países en vías de desarrollo y menos adelantados en cuanto al acceso a los medicamentos, así como los diversos casos de conflictos internacionales que se han suscitado a la fecha como consecuencia de la implementación de la legislación internacional a los sistemas legales de dichos países y las fexibilidades que ofrece la legislación internacional en cuanto a la implementación de la misma. Terminando este estudio con una serie de conclusiones y recomendaciones que nos llevan a confirmar la hipótesis expuesta: "Las disposiciones del ADPIC en materia de patentes farmacéuticas son flexibles a las políticas de salud públicas de los países en desarrollo y no de estricta aplicación legal como argumentan las industrias farmacéuticas."
