There have been concerns raised about inadequate safeguards for such individuals receiving care through state Medicaid home and community-based services waivers. CMS approves and oversees these waivers. Safeguards include the review of, and follow-up action to, critical incidents -- events that harm or have the potential to harm waiver beneficiaries. The Home and Community-Based Service 1915 (c) (HCBS) waiver program is the primary funding provider for long-term care services (LTSS) to individuals with Developmental Disabilities (DD). The Center of Medicaid and Medicare (CMS) implemented a new regulation called CMS HCBS Setting Final Rule. This new rule sets requirements for states to implement on providers whose settings receive HCBS funding. This literature review demonstrates the need for more in-depth policy analysis and research for the process for policymaking and implementation of HCBS policies to help ensure that individuals with DD continue to have the tools and support for enhanced quality of life. This research demonstrates a lack of data on the new CMS HCBS Setting Final Rule, which can compromise the lives of DD individuals. Also, there is a lack of knowledge of the new CMS HCBS setting rule and a lack of DD individuals and stakeholders' involvement. Individuals with DD need to assume more leadership roles to advocate and make a difference in how these policies are created and implemented to meet proper meaningful integration successfully.
