"Esta investigación cae dentro del ámbito de la “teoría general del derecho”. Si se pudiera dejar de lado la tradición idiomática, definiríamos nuestro ámbito de investigación simplemente con las palabras “teoría del derecho”. Pero este término puede conducir a una confusión con la jurisprudencia que tiene por objeto el derecho positivo (“ciencia del Derecho”). La expresión “teoría general del Derecho” sería la más adecuada, pero en la tradición idiomática científica alemana suena algo extraña. Cuando más adelante utilizamos la expresión “teoría general del derecho” no deben vincularse a ella ningún tipo de concepciones metodológicas tradicionales. Una “enciclopedia jurídica” general construida sobre la base del derecho positivo es una disciplina pedagógica, que puede ser valiosa como introducción al estudio del derecho. Pero una disciplina pedagógica no puede ser, al mismo tiempo, una teoría pura. ¿Es posible una teoría general del derecho? Sólo cuando existe una estructura sociológica, siempre recurrente; el “derecho”, es decir una estructura en la cual, en las diferentes comunidades dadas históricamente es verificable una cantidad suficiente de legalidades siempre recurrentes, de invariantes estructurales y socio-psico-lógicas. Este presupuesto existe no sólo en los actuales estados civilizados de Occidente, aun cuando estas invariantes sean aquí especialmente numerosas. Se podría preguntar, desde luego, si no sería adecuado limitar una “teoría general del derecho” a estas comunidades jurídicas. En nuestro libro algunas explicaciones estarán efectivamente limitadas en este sentido.
