The use of economic sanctions to stem weapons proliferation acquired a new dimension in the 1990's. While earlier legislation required the cut-off of foreign aid to countries engaged in specified nuclear proliferation activities and mentioned other sanctions as a possible mechanism for bringing countries into compliance with goals of treaties or international agreements, it was not until 1990 that Congress enacted explicit guidelines for trade sanctions related to missile proliferation. In that year a requirement for the President to impose sanctions against US persons or foreign persons engaging in trade of items or technology listed in the Missile Technology Control Regime Annex (MTCR Annex) was added to the Arms Export Control Act and to the Export Administration Act of 1979. Subsequently, Congress legislated economic sanctions against countries that contribute to the proliferation of chemical, biological, and nuclear weapons in a broad array of laws. This book offers a listing and brief description of legal provisions that require or authorise the imposition of some form of economic sanction against countries, companies, or persons who violate U.S. non-proliferation norms. For each provision, information is included on what triggers the imposition of sanctions, their duration, what authority the President has to delay or abstain from imposing sanctions, and what authority the President has to waive the imposition of sanctions.

This book examines the interplay between sanctions and nuclear disarmament and non-proliferation. The volume aims to tackle three separate but closely intertwined issues: It aims to revisit the debate on, and deconstruct the concept of, sanctions; to provide a working theoretical framework; to differentiate between positive sanctions (or incentives or carrots) and negative sanctions; to identify the actors who may initiate sanctions (i.e. states, regional, and/or international organizations); to ascertain the legality and legitimacy of such sanctions taking place; to problematize and discuss the utility of sanctions; and so on. The U.S. uses sanctions to curb proliferation of weapons of mass destruction. Under the 2006 Iran, North Korea, and Syria Nonproliferation Act (INKSNA), the President is required every 6 months to provide reports to two congressional committees that identify every foreign person for whom there is credible information that the person has transferred certain items to or from Iran, North Korea, or Syria. INKSNA authorizes the President to impose sanctions on the identified person and requires him to provide justification if sanctions are not imposed. The President has delegated this authority to the State Department (State). This report (1) examines State's timeliness in providing INKSNA reports; (2) reviews State's reporting process; and (3) identifies the potential impact of its reporting timeliness on the imposition of sanctions.
