In an action for personal injuries sustained by a pedestrian on falling into a defective coalhole in a sidewalk, it was held not erroneous to admit in evidence ordinances of the defendant city defining the duties of police oflicers with respect to reporting defects in streets, especially where the city ma_de independent oral proof by its witnesses of the duty of oflicers to report defective sidewalks. 14. Damages-Personal Injuries--Woman---Excessiveness. A verdict for $3,388.00 awarded a woman, 35 years of age and in good health before her injury, for permanent injuries sustained by falling into a coalhole in a sidewalk, which left her for years in a seriously crippled condition and caused her much suffering and pain, held not excessive. the covering. The boys placed tW0 such as the one in this case would make' props under the boards, but when plaintiff came along two or three hours afterwards one of the boards gave way so that he fell and was injured. There was testimony to the efiect that the oflicer, an hour after he had instructed the boys to repair the covering, tested the boards by jumping on them, and that he found them safe. In afiirming a judgment for plaintiff, the court held (1) that a demurrer to the evidence had properly been overruled. "Whether OI' not," the court said, "it was the custom for the property owner to fix defects no difl'erence, as the city under the law of this state was under the absolute and unqualified duty to keep its sidewalks reasonably safe for pedestrians." Excerpt: ...negligence on account of the carelessness of the operator; that plaintiff could recover for the injuries sustained, although she could not recover for fright alone, it appearing that the fright was accompanied by physical injuries; and that it was not necessary that the operator should have anticipated that this particular accident would happen, as he was bound to know that if he left the car so circumstaneed that any person might enter it, and start it up, it might happen that someone would do so. Cohn v. Ansonia Realty Co., 148 N. Y. Supp. 39 (1914). On the same state of facts as above set forth, and for the same reasons there stated, a separate action by the husband of the plaintiff in the foregoing case for damages for the loss of services of his wife, resulted in a verdict in his favor for $1,000, which was affirmed. L., while riding on a railway train, was struck by a rock or boulder which rolled from the mountain side, and received an injury for which he sought to recover damages from the railroad company; the evidence failed to show the cause which set the rock in motion or the place from which it started, but did satisfactorily show that the stone did not come from the face of the cut through which the train was running or from the company's right of way, and the evidence failed to show any negligence on the part of the company. Held, that the railroad company was not liable for damages sustained on account of the injury thus received.. 2. Ca.rriers--Injury to Passenger---0ause--Burden of Proof.
