The open access publication of this book has been published with the support of the Swiss National Science Foundation. International law is increasing in relevance to the topic of secession. This book demonstrates that if a secessionist entity’s effectiveness is achieved in violation of peremptory norms, the emergence of statehood is precluded, thereby challenging a classical view of secession as purely factual and meta-legal. Dr. Júlia Miklasová coins the term “illegal secessionist entity,” demonstrates the pervasive effects of the original illegality on the subsequent relations of such entities (purported diplomatic, treaty, economic relations, acts and laws) and outlines the overlapping regimes of the law of occupation, human rights law and duty of non-recognition. Post-Soviet secessionist entities result from an illegal use of force. They are thus prohibited from becoming States, and further consequences of their illegality apply.

How do governments govern today and how well do they do it? How do governments choose the tools or instruments they will use to get things done? In today's world, how could these decisions be improved from the standpoint of efficiency, effectiveness, legitimacy and accountability? "Designing Government" brings together leading experts to examine the "instrument choice" perspective on government and public policy over the past two decades. The authors examine such issues as accountability, effectiveness, sustainability, legitimacy, and the impact of globalization. This book is a second, revised edition of the original 1986 publication. Since then, the issue of contract change has increasingly challenged the business community and legal practitioners. The world-wide recession may well have accelerated the need to secure contractual relationships by reasonable flexibility. Successful foreign investment, a relentless challenge, is subject to many unpredictable errors. Of all these variables, however, successful investment is most dependent on the investor-host country relationship, which is the object of the present study. In particular, the pressure by host countries for contract change and its counterpart: the investor's defence of contract stability. ECDL2000, the Fourth European Conference on Research and Advanced Te- nology for Digital Libraries, is being held this year in Lisbon, Portugal, following previous events in Pisa (1997), Heraklion (1998), and Paris (1999). One major goal of the ECDL conference series has been to draw information professionals, stakeholders, and user communities from both the research world and from - dustry into a discussion of the alternative technologies, policies, and scenarios for global digital libraries. The success of previous conferences makes them a hard act to follow. The eld of digital libraries draws on a truly diverse set of scienti c and technical disciplines. In the past three years, moreover, global cooperation on research and development has emerged as an urgent priority, particularly in the new European Framework Programme and in the Digital Library Initiative in the United States. Because of this diversity, the eld is perhaps still struggling for an identity. But this struggle for identity is itself a source of energy and creativity. P- ticipants in this eld feel themselves to be part of a special community, with special people. Each of us may claim expertise on a narrow issue, with speci c projects, but the choices we make and the methods we use in local solutions can have unforeseen impacts within a growing universe of interconnected resources.
