Excerpt from The Mining Laws of the Republic of Colombia: With a Short Explanation of Their Application and Official Forms for Notices, Denouncements and Applications for Title In 1857 Granada adopted a Federal constitution and the Province of Antioquia became a State of the same name. The Legislature of this State, which has held and still holds the first rank among the mining States of Colombia, on October 3, 1864, passed a law, known as Ley 38, which repealed all existing mining laws. But the provisions of this law were quickly found to be very unsatisfactory, and almost immediately after its pas sage the State Legislature began to study the provisions of a new and more complete law on the subject; a law which would encourage mining, and which, while interesting and afi'ording protection to capital invested in the mining industry, would at the same time provide that the mining lands. Granted by the State in fee simple, should yield a revenue to it. The result Of their labors was Ley 127, passed October 21, 1867, and known as the Codz'go dc M'nas dc Antz'oym'a. This law forms the nucleus of the present Mining Law of the Republic Of Colom bia. The Code was first amended by Ley 209, passed November 2, 1871, but the amendments failed to give satisfaction and they were repealed and others were substituted by Ley 292, passed September 20. 1875. The last amendments made by the Legis lature of the State of Antioquia were passed December 4, 1877, and were known as Ley 38. Concerning this law, it is to be Observed that two of its articles have been suspended by the Federal Supreme Court, on January 13, 1879. Article 4 of Ley 38, declared excepted from denouncement the bed and banks of the Cauca River to high flood mark (vide page The sus pension of this article was only partial, the Court deciding that the provisions of said article could in no wise afi'ect the rights already acquired at the time of its passage. Article 7 of Ley 38 provided that where the working of a mine was suspended, the owner of another mine could take for his mine the water used in the first. (v ide page This provision was declared uncon stitutional by the Supreme Court and was totally suspended.
