The surprising truth about intermarriage in 19th-Century California. Until recently, most studies of the colonial period of the American West have focused on the activities and agency of men. Now, historian María Raquél Casas examines the role of Spanish-Mexican women in the development of California. This book is based on an extensive field work in which the author tried to study the customary law of property of an African agrarian tribal community of Āma - also known as Nyimaŋ - of the Nuba Mountains in the northern Sudan. The writer has tried to explain the nature of property holding in the light of the people's philosophy evidenced in their social structure and their traditional beliefs. Special attention is paid to the traditional structure of political leadership in this highly segmented society that was prone not only to inter-tribal wars but was also in a constant 'fission and fusion' among themselves when not at war with other neighboring tribes. In discussing jurisdictional issues, and traditional settlement mechanisms based partly on law and custom, both adopted by this egalitarian society, the study is made currently relevant by keen observation on the effect of modernity on traditional ethics and morality of the Āma society that was once described by some authors as being 'impervious to foreign influence". Furthermore, the reception and assimilation of the state law together with the Shari'ah laws in various areas such as that relating to property devolution, family institution, and burial rites is treated as being of great significance in the overall development of the tribal customary laws. Like any other Nuba tribe, the consciousness of the Āma people of their ethos of identity marks their ferociously guarded customs and traditions prevalent up-to-date. Owning Land, Being Women enquires into the processes that establish inheritance as a unique form of property relation in law and society. It focuses on India, examining the legislative processes that led to the 2005 amendment of the Hindu Succession Act 1956, along with several interconnected welfare policies. Scholars have understood these Acts as a response to growing concerns about women’s property rights in developing countries. In re-reading these Acts and exploring the wider nexus of Indian society in which the legislation was drafted, this study considers how questions of family structure and property rights contribute to the creation of legal subjects and demonstrates the significance of the politico-economic context of rights formulation. On the basis of an ethnography of a village in West Bengal, this book brings the moral axis of inheritance into sharp focus, elucidating the interwoven dynamics of bequest, distribution of family wealth and reciprocity of care work that are integral to the logic of inheritance. It explains why inheritance rights based on the notion of individual property rights are inadequate to account for practices of inheritance. Mondal shows that inheritance includes normative structures of affective attachment and expectations, i.e., evaluatively-charged imaginaries of the future that coordinate present practices. These insights pose questions of the dominant resource-based conceptualisation of inherited property in the debate on women’s empowerment. In doing so, this work opens up a line of investigation that brings feminist rights discourse into conversation with ethics, enriching the liberal theory of gender justice.

Many historians of late have portrayed upper-class southerners of the antebellum period as inordinately aristocratic and autocratic. Some have even seen in the planters’ family relations the faint yet distinct shadow of a master’s dealings with his slaves. Challenging such commonly held assumptions about the attitudes and actions of the pre-Civil War southern elite, Jane Turner Censer draws on an impressive array of primary and secondary sources—including letters, diaries, and other first-person accounts as well as federal census materials and local wills, deeds, and marriage records—to show that southern planters, at least in their relations with their children, were caring, affectionate, and surprisingly egalitarian. Through the close study of more than one hundred North Carolina families, she reveals the adults to have been doting parents who emphasized to their children the importance of education and achievement and the wise use of time and money. The planters guided their offspring toward autonomy by progressively granting them more and more opportunities for decision making. By the time sons and daughters were faced with choosing a marriage partner, parents played only a restrained advisory role. Similarly, fathers left career decisions almost entirely up to their sons. Censer concludes that children almost invariably met their parents’ high expectations. Most of them chose to marry within their class, and the second generation usually maintained or improved their parents’ high economic status. On the other hand, Censer finds that planters rarely developed warm, empathetic relationships with their slaves. Even the traditional “mammy,” whose role is southern planter families was been exalted in much of our literature, seems to have held a relatively minor place in the family structure. Bringing to light a wealth of previously unassimilated information, North Carolina Planters and Their Children points toward a new understanding of social and cultural life among the wealthy in the early nineteenth-century South.
