Avec le mouvement des sans-papiers, avec la loi Debré sur l'immigration et les protestations populaires qu'elle a suscitées, avec les premières décisions du gouvernement de Lionel Jospin, la question des étrangers en situation irrégulière est devenue un enjeu majeur de la vie publique française. Les mobilisations collectives ont révélé les incohérences d'un dispositif législatif et administratif qui, non seulement, avait peu d'effet sur l'immigration clandestine, mais produisait lui-même l'irrégularité qu'il était censé réprimer. Comment en est-on arrivé à cette situation où la confusion entretenue autour des politiques de l'immigration et de leurs effets, a permis de légitimer les discours xénophobes et les pratiques discriminatoires ? C'est d'abord à cette question qu'ont voulu répondre les auteurs de ce livre. Ils rappellent ainsi comment la France, depuis plus de vingt ans, a défini, de manière toujours plus restrictive, les conditions de l'immigration et le statut des étrangers. Et comment, plus encore que la répression de ceux qu'on a abusivement appelés des clandestins, la loi a fragilisé l'existence quotidienne de l'ensemble des étrangers. La rhétorique opposant les immigrés réguliers qu'il s'agirait d'intégrer, et les irréguliers qu'il faudrait expulser, apparaît ainsi comme une mystification. Mais ce que l'ouvrage montre aussi, c'est que la société française a été profondément affaiblie par cette remise en cause des fondements de son contrat social : limitation du droit d'asile, entrave au regroupement familial, précarisation dans le monde du travail, tolérance à l'égard des actes racistes et, finalement, renoncements multiples aux principes de la démocratie. La leçon des sans-papiers engage ainsi une certaine conception de la justice, de la citoyenneté et, tout simplement, de l'hospitalité que les auteurs de ce livre entendent défendre.

The police and the courts depend on the cooperation of communities to keep order. But large numbers of urban poor distrust law enforcement officials. Legitimacy and Criminal Justice explores the reasons that legal authorities are or are not seen as legitimate and trustworthy by many citizens. Legitimacy and Criminal Justice is the first study of the perceived legitimacy of legal institutions outside the U.S. The authors investigate relations between courts, the police, and communities in the U.K., Western Europe, South Africa, Slovenia, South America, and Mexico, demonstrating the importance of social context in shaping those relations. Gorazd Meško and Goran Klemencic examine Slovenia's adoption of Western-style "community policing" during its transition to democracy. In the context of Slovenia's recent Communist past—when "community policing" entailed omnipresent social and political control—citizens regarded these efforts with great suspicion, and offered little cooperation to the police. When states fail to control crime, informal methods of law can gain legitimacy. Jennifer Johnson discusses an extra-legal policing system carried out by farmers in Guerrero, Mexico—complete with sentencing guidelines and initiatives to reintegrate offenders into the community. Feeling that federal authorities were not prosecuting the crimes that plagued their province, the citizens of Guerrero strongly supported this extra-legal arrangement, and engaged in massive protests when the central government tried to suppress it. Several of the authors examine how the perceived legitimacy of the police and courts varies across social groups. Graziella Da Silva, Ignacio Cano, and Hugo Frühling show that attitudes toward the police vary greatly across social classes in harshly unequal societies like Brazil and Chile. And many of the authors find that ethnic minorities often display greater distrust toward the police, and perceive themselves to be targets of police discrimination. Indeed, Hans-Jöerg Albrecht finds evidence of bias in arrests of the foreign born in Germany, which has fueled discontent among Berlin's Turkish youth. Sophie Body-Gendrot points out that mutual hostility between police and minority communities can lead to large-scale violence, as the Parisian banlieu riots underscored. The case studies presented in this important new book show that fostering cooperation between law enforcement and communities requires the former to pay careful attention to the needs and attitudes of the latter. It seems the world is becoming increasingly uniform culturally. To a certain degree, this observation is correct in the sense that a global mass culture is certainly being disseminated an sold all over the plane. But the world is at the same time increasingly diversified in terms of ethno-cultura identities. The tension between the trend toward cultural uniformity and the trend toward differentiation of identities is well captured by observing the evolution of social dynamics in cities.
