Aside from self-defence, a UN Security Council authorisation under Chapter VII is the only exception to the prohibition on the use of force. Authorisation of the use of force requires the Security Council to first determine whether that situation constitutes a ‘threat to the peace’ under Article 39. The Charter has long been interpreted as placing few bounds around how the Security Council arrives at such determinations. As such commentators have argued that the phrase ‘threat to the peace’ is undefinable in nature and lacking in consistency. Through a critical discourse analysis of the justificatory discourse of the P5 surrounding individual decisions relating to ‘threat to the peace’ (found in the meeting transcripts), this book demonstrates that each P5 member has a consistent definition and understanding of what constitutes a ‘threat to the peace’.

This book delves into the major developments triggered by the hydrocarbon discoveries in the Eastern Mediterranean over the last twenty years, focusing on maritime boundary delimitation. Examining the impact that the hydrocarbon discoveries have had on the application of the law of the sea rules by the East Med states, the book looks at the new trends concerning the implementation of the law of the sea in the region. The book analyses regional state practice in terms of maritime delimitation, namely the conclusion of bilateral agreements based on the law of the sea rules, both conventional and customary, reflecting the East Med states’ willingness to cooperate in order to reap the benefits of the energy windfall. Alongside this analysis, an outline of the hydrocarbon discoveries and the pertinent maritime activities is given, as well as further coverage of the overlapping maritime claims and disputes between Greece, Cyprus and Turkey on one side, and Lebanon and Israel on the other. Moreover, the book examines the validity of maritime claims made by or through non-state entities in the region, namely the State of Palestine, the UK Sovereign Base Areas and the so-called ‘Turkish Republic of Northern Cyprus’ and their potential impact on the delimitation agreements already in place. This book describes the problems encountered by UN inspection teams assigned to find and destroy Iraq’s nuclear, chemical, biological, and missile capabilities following Desert Storm. Kathleen C. Bailey focuses on the initial inspections—the period in which Iraq was struggling to camouflage and conceal its weapons and production equipment as inspectors were trying to define their role in the process. Working from interviews with these initial inspectors, Bailey extracts important lessons for future verification efforts. On-site arms control inspectors in Iraq found information to be carefully controlled by the government. Pertinent documentation was destroyed, only selected people were allowed to interact with inspectors, and officials refused to make full, complete declarations. Buildings were tom down, equipment was moved, and un-exploded ordnance was placed in the way. These and other techniques helped Iraq to hide its past activities and to preserve some of its weapons capabilities. In the future, arms control inspectors will need to develop strategies for dealing more effectively with recalcitrant inspectees and for creating the best possible procedures and processes. Bailey concludes with concrete suggestions for overcoming some of these obstacles with more effective inspection practices.
