L'ampleur des objectifs de la politique communautaire de l'environnement ainsi que la dynamique des principes directeurs de cette politique légitiment la compétence de la Communauté européenne pour contrôler et réguler l'activité des entreprises polluantes ou susceptibles de le devenir. La plus-value environnementale escomptée en raison de l'intervention de la Communauté, en conditionne le déclenchement, conformément au principe de subsidiarité. La même logique de subsidiarité ascendante justifie la référence à une définition communautaire de l'entreprise. Nathalie Hervé-Fournereau considère que celle donnée par la Cour dans le cadre du droit de la concurrence est aussi pertinente dans le champ du droit environnemental. Elle fonde donc son approche sur une définition duale de l'entreprise ; celle-ci est en effet tour à tour appréhendée en tant qu'" activité économique " et en tant qu'" entité économique ". Soumise aux lois du marché, du fait même de son activité économique, l'entreprise n'en doit pas moins concilier sa liberté d'entreprendre avec les exigences du droit communautaire de l'environnement, placé de façon de plus en plus cohérente sous le signe d'une " croissance durable " (Traité de Maastricht), d'un " développement durable " (Traité d'Amsterdam). L'entreprise est appelée à vivre autrement. " L'entité économique " est naturellement et nécessairement appelée à se voir reconnaître un statut d'acteur à part entière du droit communautaire de l'environnement. L'entreprise devient partenaire et participe à une régulation juridique plurivoque de la société. L'emprise croissante de l'entité économique s'accompagne inévitablement d'une invitation à exercer pleinement ses responsabilités, quels que soient les défis qui se profilent à l'horizon. Il suffit de penser aux élargissements programmés et à la mondialisation du commerce sous l'impulsion et le contrôle de l'Organisation mondiale du commerce.
