Le droit français offre à l'acheteur insatisfait du bien vendu de nombreux moyens d'action. Or, cette diversité est source de confusions en raison de la proximité des faits que ces actions recouvrent. Il en résulte que le droit de la vente apparait a la fois complexe et fluctuant. Cette complexité trouve sa source dans un certain archaïsme des textes du code civil et dans la confusion entre les notions de responsabilité et de garantie. Elle a été favorisée par une partie de la jurisprudence, désireuse de profiter de la proximité entre les actions de la vente pour accueillir largement la demande de l'acquéreur et accentuée par la découverte de nouvelles actions a son profit. Pour remédier à ce désordre la jurisprudence distingue désormais strictement le vice cache et la non-conformité et elle tente de cloisonner les actions de l'acheteur les unes par rapport aux autres. Si cette solution peut sembler salutaire, elle n'en présente pas moins de sérieux défauts qui justifient d'envisager d'autres remèdes. Le premier de ces remèdes consisterait à réduire les disparités excessives entre les actions offertes a l'acquéreur. Le second impliquerait une reforme plus profonde, destinée à englober sous une même action le vice caché et la non-conformité. L'enchevêtrement des actions de l'acheteur est également du a la place accordée à l'obligation de sécurité dans la vente. Alors que la transposition en droit français de la directive sur la responsabilité du fait des produits défectueux aurait pu être l'occasion de renforcer l'autonomie de l'obligation de sécurité, en dissociant la réparation des dommages corporels des autres dommages dont l'acheteur peut se plaindre, la loi du 19 mai 1998 ne fait qu'ajouter aux actions existantes une action spéciale qui existait déjà en droit interne. En outre, si elle simplifie quelque peu l'indemnisation des dommages, elle se révèle à plusieurs égards moins favorable a la victime que le régime issu du droit commun de la responsabilité.

Fiscal Disobedience represents a novel approach to the question of citizenship amid the changing global economy and the fiscal crisis of the nation-state. Focusing on economic practices in the Chad Basin of Africa, Janet Roitman combines thorough ethnographic fieldwork with sophisticated analysis of key ideas of political economy to examine the contentious nature of fiscal relationships between the state and its citizens. She argues that citizenship is being redefined through a renegotiation of the rights and obligations inherent in such economic relationships. The book centers on a civil disobedience movement that arose in Cameroon beginning in 1990 ostensibly to counter state fiscal authority--a movement dubbed Opération Villes Mortes by the opposition and incivisme fiscal by the government (which for its part was eager to suggest that participants were less than legitimate citizens, failing in their civic duties). Contrary to standard approaches, Roitman examines this conflict as a "productive moment" that, rather than involving the outright rejection of regulatory authority, questioned the intelligibility of its exercise. Although both militarized commercial networks (associated with such activities trading in contraband goods including drugs, ivory, and guns) and highly organized gang-based banditry do challenge state authority, they do not necessarily undermine state power. Contrary to depictions of the African state as "weak" or "failed," this book demonstrates how the state in Africa manages to reconstitute its authority through networks that have emerged in the interstices of the state system. It also shows how those networks partake of the same epistemological grounding as does the state. Indeed, both state and nonstate practices of governing refer to a common "ethic of illegality," which explains how illegal activities are understood as licit or reasonable conduct.
