"'Legitimacy' has held an unwavering prominence within Western political philosophy. It is to an extent its founding debate as to the rightful use of power (Mulligan 2006). Weberian influenced legitimacy studies have more recently aimed to prise empirical legitimacy from normative, what is over what should be, in the service of good social science. In this book, I argue that empirical legitimacy remains only partially represented. This partiality is due to an entrenched focus on the actions of state elites and state, or inter-state, institutions. From legitimacy's earliest framings, theorists have conflated political power with state power. The state is legitimate force: ergo legitimacy is the state. Its study is thus hamstrung by recursive, state-based rationalities, which mask the extent to which Western norms and normativity imbue world politics and its study (Dodworth 2014; 2018a)"--

Legitimation by Constitution is the phrase, coined by distinguished authors Frank Michelman and Alessandro Ferrara, for a key idea in Rawlsian political liberalism of a reliance on a dualist form of democracy-a subjection of ground-level lawmaking to the constraints of a higher-law constitution that most citizens could find acceptable as a framework for their politics-as a response to the problem of maintaining a liberally just, stable, and oppression-free democratic government in conditions of pluralist visionary conflict. Legitimation by Constitution recalls, collects, and combines a series of exchanges over the years between Michelman and Ferrara, inspired by Rawls' encapsulation of this conception in his proposed liberal principle of legitimacy. From a shared standpoint of sympathetic identification with the political-liberal statement of the problem, for which legitimation by constitution is proposed as a solution, these exchanges consider the perceived difficulties arguably standing in the way of this proposal's fulfillment on terms consistent with political liberalism's defining ideas about political justification. Legitimacy is generally a term that is associated with the state. The term surfaces when there are problems with state legitimacy—when it is lacking or absent. This present volume attempts to think through the relevance of the concept of legitimacy for other political actors than the state. Rebel groups, in the shape of insurgents, terrorists, warlords and guerrillas, are all engaged in a process of claim making as legitimate actors representing certain political agendas and constituencies. We are interested in dissecting the processes of the emergence of legitimacy in contexts of disorder and conflict. Legitimacy is not only a belief or belief system that informs social action, but it is also a practice with a repertoire of legitimacy claiming, reinforcing, copying and emulating elements. Governance provision is an important legitimacy generating activity, just as it has been in the formation of states. The volume, however, points out that there are many more aspects to legitimacy that deserve attention.
