This book charts the evolution of the Legal Services Ombudsman for England and Wales. Established in 1990, it had a statutory remit that explicitly recognized its dual responsibility for consumer dispute resolution and democratic accountability. It was replaced in 2010 by a very different type of ombudsman institution. The book describes how the Ombudsman reconciled its different roles and how far it succeeded in changing the mentality of the legal profession. The authors relate the Ombudsman’s successes and failures to current debates facing the ombudsman and regulatory community, and highlight the continuing potential of the ombudsman institution. The ombudsman institution emerges as a ‘third way’ between the courts and various forms of alternative dispute resolution, and as a creative and democratic means of responding to public grievance.

The Legal Services Ombudsman oversees the handling of complaints about solicitors, barristers, legal executives, licensed conveyancers and patent agents by the five professional bodies responsible for setting and maintaining standards of conduct and service within the legal profession. The Ombudsman was only satisfied with the way in which the Law Society's Office for the Supervision of Solicitors (OSS) handled complaints in 59% of the cases investigated in 1999/2000. Progress in client care, regulatory review and more comprehensive and regular research has been slow and unco-ordinated. Any lasting progress will depend on the Law Society managing to persuade solicitors to adopt a more client-focused approach to complaints handling. The task of the OSS is to deal with dissatisfaction, the task of the Law Society is to help solicitors prevent dissatisfaction occurring in the first place. The Bar Council's handling of complaints was satisfactory in 97% of the cases investigated by the Ombudsman.
