Les inégalités entre homme et femme qui sont consacrées par le droit pénal libanais intéressent globalement le sujet de cette thèse, mais notre objectif tend plus spécialement à démontrer la manière particulière dont la femme est traitée par le législateur libanais, lorsqu'elle se rend coupable ou se trouve victime d'une certaine catégorie d'infractions liées à la sexualité, la moralité, la procréation, la famille et l'honneur. Toutefois, nous n'aborderons pas seulement ce sujet selon le droit libanais, mais aussi selon le droit français, en comparant avec les textes de l'ancien Code pénal français et ceux du Code nouveau. Il s'agit de comparer entre les deux droits répressifs français et libanais selon deux parties. Partie I : La protection de la sexualité féminine et de l'enfantement. Partie II : La protection de l'intégrité et de l'honneur de la femme dans le cadre familial. Dans le cadre de la 1ère partie, il convient d'examiner dans un 1er titre, les atteintes au sexe féminin. Il s'agit de toutes les atteintes sexuelles par agression qui englobent le viol et les autres actes sexuels portant atteinte à la pudeur. Il s'agit aussi d'analyser les infractions relatives à la séduction morale et sexuelle surtout commises envers les filles mineures, des actes de provocation à la débauche et à la prostitution, ainsi que les infractions d'enlèvement et de rapt par violence ou par séduction. Etant une finalité de la sexualité, la question de la procréation se pose dans le 2nd titre de cette partie 1, où les infractions liées à l'enfantement seront exposées : l'avortement ou les interruptions de grossesse, et l'infanticide. Dans le cadre de la 2nd partie, il est nécessaire d'étudier dans un 1er titre, la prise en compte du lien conjugal en développant les infractions de violences au sein du couple et le délit d'adultère en droit pénal libanais. Ensuite dans le 2nd titre, il faut élaborer la notion d' « honneur » dans la société libanaise en abordant les meurtres commis au nom de l'honneur à l'encontre des femmes d'une même famille, y compris la mère, constituant ainsi le crime du matricide.

This book answers two basic but under-appreciated questions: first, how does the American criminal justice system address a defendant's family status? And, second, how should a defendant's family status be recognized, if at all, in a criminal justice system situated within a liberal democracy committed to egalitarian principles of non-discrimination? After surveying the variety of "family ties benefits" and "family ties burdens" in our criminal justice system, the authors explain why policymakers and courts should view with caution and indeed skepticism any attempt to distribute these benefits or burdens based on one's family status. This is a controversial stance, but Markel, Collins, and Leib argue that in many circumstances there are simply too many costs to the criminal justice system when it gives special treatment based on one's family ties or responsibilities. Privilege or Punish breaks new ground by offering an important synthetic view of the intersection between crime, punishment, and the family.
