Ayant été l'exclusivité de l'OMPI, cette protection devient conjointement assurée par le GATT depuis l'ouverture de l'Uruguay Round. De l'OMPI au GATT, le transfert du centre de gravité a eu pour motivation plusieurs éléments politiques et économiques, dont le commerce des marchandises de contrefaçon et, en particulier, le réajustement de la politique commerciale des Etats-Unis dans les années 70 et 80. Sur une telle voile de fond, les négociations sur les TRIPS ont finalement abouti à la conclusion d'un accord spécifique, qui prévoit respectivement les principes généraux visant la protection des DPI, les normes des DPI et les moyens de les faire appliquer. Une présentation analytique de cet accord est ici fournie, afin de montrer le cadre de la protection des DPI organisée dans l'enceinte du GATT. Globalisé dans l'ensemble des arrangements issus de l'Uruguay Round, le régime juridique ainsi établi permet des avantages manifestes, notamment sur le plan de la mise en œuvre de la protection, et marque un progrès remarquable par la recherche d'une protection de haut niveau.
