Issues des grandes lois sociales instaurées par la IIIe République à la fin du XIXe siècle et au début du XXe siècle, inscrites dans le Préambule de la Constitution de 1946 (alinéa 11), l'aide et l'action sociales sont aujourd'hui, aux côtés de la Sécurité sociale, le second pilier de notre système de protection sociale. Aide et action sociales comprennent trois niveaux : l'aide sociale dite "légale", accessible de droit pour les individus remplissant les conditions d'obtention fixées par la loi (aide médicale d'Etat, aide sociale à l'enfance, aux personnes âgées ou handicapées, aide sociale à l'insertion) ; l'aide sociale dite "extralégale" qui reprend les dispositifs de l'aide sociale légale, mais pour laquelle l'organisme chargé de l'attribution décide de montants d'aide plus favorables ou de conditions d'octroi plus souples ; et enfin, l'action sociale qui recouvre toutes les mesures facultatives que des organismes publics ou privés (collectivités territoriales, organismes de sécurité sociale, mutuelles, caisses de retraites, associations, etc.) peuvent engager, de façon discrétionnaire, auprès de populations ciblées, en dehors ou en complément des régimes de sécurité sociale et de l'aide sociale. Partant, on voit bien que l'aide et l'action sociales constituent un ensemble complexe qui, au-delà du strict cadre défini par la loi, permet, voire encourage, la diversité des mesures d'accompagnement. L'intérêt de cet ouvrage est donc d'aborder quantité de questions qui sont au coeur des institutions et des politiques induites par le droit de l'aide et de l'action sociales : qu'il s'agisse du rôle de l'éthique dans la mise en oeuvre des politiques sociales ou de la position spécifique qu'occupe le droit qui les régit au sein de l'ordonnancement juridique (entre droit public et droit privé) ; qu'il s'agisse des règles applicables aux usagers (droits et devoirs, modalités d'accueil) ou à certains publics spécifiques (mineurs étrangers non accompagnés, gens du voyage), des pratiques qui impactent les actions mises en oeuvre (évaluation, rôle des données numériques, secret et partage d'informations) ou des partages qui structurent les compétences (entre Etat et département) ; ou qu'il s'agisse des dispositions qui régulent à la fois l'accès aux prestations (lieu de résidence) et la défense du droit (régime pré-contentieux et contentieux), de la situation qui prévaut à l'étranger (Belgique) ou encore du devenir du système global de protection (aide/action sociales et sécurité sociale).

Since the Doi Moi policy of economic renovation was introduced in 1986, Vietnam has undergone deep transformations as a result of the transition to a socialist-oriented market economy. Social and urban transition has taken place in parallel, as urban dynamics were spurred on by Vietnamese public and private stakeholders, and by external agents such as international organizations and international solidarity organizations, experts, consultants and bilateral aid organizations.Here are the results of research carried out by French, Canadian and Vietnamese teams from the north and south of the country on the overarching theme of Vietnamese cities in transition. Some of this research deals with urban dynamics, some with the issues at stake within such dynamics, or with the strategies of the most significant stakeholders in urban transition: civil society, donors within the framework of official aid for development, consultants and international consultancy firms. These projects were carried out between 2001 and 2004 as part of the Urban Research Programme for Development (PRUD), and mainly focus on Hanoi and Ho Chi Minh City, or both in the case of comparative studies.Is there such a thing as a Vietnamese model of an Asian city? It seems that urban transition in Vietnam is not taking place in as radical and abrupt a manner as in China. The country's capacity for absorbing external models, the quest for a third way between state intervention and economic liberalism, and the fact that the country's architectural heritage is taken into account in urban planning, are just some of the reasons for its particularity.
