Il n'existait aucun article spécifique concernant la politique communautaire des consommateurs dans le traité de Rome (1957) et dans l'acte unique européen (1986). Le traite de Maastricht (1992) instituant l'union européenne a comblé cette lacune : la politique communautaire des consommateurs est, pour la première fois dans la construction européenne, consacrée. La protection des consommateurs est visée expressément par l'article 129a. Un titre XI intitulé "la protection des consommateurs " est crée pour inclure ce nouvel article. Ce progrès est renforce par le traite d'Amsterdam (1997) ; la nouvelle rédaction de l'article 129a (devenu depuis l'article 153) étend le champ de l'action communautaire. L'article 129a précise les moyens d'intervention. Dans le cadre du marché unique, la communauté prend des mesures sur la base de l'article 100a. En dehors du cadre du marché unique, la communauté doit suivre le principe de subsidiarité : l'action communautaire doit seulement pallier l'action des états membres ; elle lui est subsidiaire. Toutefois, l'énonciation de la subsidiarité par l'article 3b n'est pas accompagnée de critères précis permettant d'appliquer ce nouveau principe. L'achèvement de la politique du consommateur suppose que l'on aille au delà des interprétations discordantes de la subsidiarité.
