Bodies of Truth offers an intimate account of how apartheid victims deal with the long-term effects of violence, focusing on the intertwined themes of embodiment, injury, victimhood, and memory. In 2002, victims of apartheid-era violence filed suit against multinational corporations, accusing them of aiding and abetting the security forces of the apartheid regime. While the litigation made its way through the U.S. courts, thousands of victims of gross human rights violations have had to cope with painful memories of violence. They have also confronted an official discourse claiming that the Truth and Reconciliation Commission of the 1990s sufficiently addressed past injuries. This book shows victims' attempts to emancipate from their experiences by participating in legal actions, but also by creating new forms of sociality among themselves and in relation to broader South African society. Rita Kesselring's ethnography draws on long-term research with members of the victim support group Khulumani and critical analysis of legal proceedings related to apartheid-era injury. Using juridical intervention as an entry point into the question of subjectivity, Kesselring asks how victimhood is experienced in the everyday for the women and men living on the periphery of Cape Town and in other parts of the country. She argues that the everyday practices of the survivors must be taken up by the state and broader society to allow for inclusive social change in a post-conflict setting.

This highly original book examines the function of legal norms and institutions in the transition to - and from - apartheid. It sheds light on the neglected relationship between path dependence and the law. The Legacies of Law demonstrates that legal norms and institutions, even illiberal ones, can have an important - and hitherto undertheorized - structuring effect on democratic transitions. Focusing on South Africa during the period 1650-2000, Jens Meierhenrich finds that under certain conditions, law reduces uncertainty in democratization by invoking common cultural backgrounds and experiences. Synthesizing insights from law, political science, economics, sociology, history, and philosophy, he offers an innovative "redescription" of both apartheid and apartheid's endgame. The Legacies of Law demonstrates that in instances in which interacting adversaries share qua law reasonably convergent mental models, transitions from authoritarian rule are less intractable. Meierhenrich's careful longitudinal analysis of the evolution of law -and its effects -in South Africa, compared with a short study of Chile from 1830 to 1990, shows how, and when, legal norms and institutions serve as historical parameters to both democratic and undemocratic rule. By so doing, The Legacies of Law contributes new and unexpected insights -both theoretical and applied -to contemporary debates about democracy and the rule of law. Among other things, Meierhenrich significantly advances our understanding of "hybrid regimes" in the international system and generates important policy-relevant insights into the politics of law and courts in authoritarian regimes.

Under the aegis of the post-apartheid government, much emphasis has been placed on the transformation and democratisation of the heritage sector in South Africa since 1994. The emergent new landscape of memory relies heavily on commemorative monuments, memorials and statues aimed at reconciliation, nation-building and the creation of a shared public history. But not everyone identifies with these new symbolic markers and their associated interpretation of the past.
