D'une manière générale, la sécurité fait l'objet d'un réflexe contractualiste, réflexe fortement critiqué au regard de la conception de la responsabilité contractuelle et de la notion d'obligation. La création d'obligations légales, générales ou préventives de sécurité ainsi que l'extension du domaine de l'obligation prétorienne de sécurité ont effectivement jeté un trouble sur la nature de cette obligation. Pourtant la situation du débiteur d'une obligation de sécurité n'est manifestement pas celle d'un tiers : il n'est pas seulement tenu de respecter les droits d'autrui, il doit exécuter une prestation qui se concrétise par la mise en oeuvre des mesures nécessaires afin de prévoir et d'éviter tout risque d'accident. Au contraire du devoir, l'obligation de sécurité ordonne. En théorie, cette différence se traduit par le fait que l'obligation de sécurité est, comme toute obligation contractuelle, affectée de sanctions spécifiques, résolution pour inexécution et exception d'inexécution. Quant au domaine de l'obligation de sécurité, il se définit par rapport à ce qui fait la spécificité du contrat, sous peine de retenir une conception viciée du contrat et une obligation de sécurité artificielle. Aussi, le lien de rattachement de la sécurité au contrat passe-t-il nécessairement par l'objet de la prestation caractéristique. L'Obligation de sécurité retrouve ainsi la logique et la cohérence qu'elle avait perdues. L'étude du régime confirme l'importance primordiale de l'exécution en nature de l'obligation de sécurité. Mais le régime n'en demeure pas moins essentiellement axé sur la réparation de la victime, ce qui parait, somme toute, bien naturel en matière de responsabilité civile. Toutefois, on note une tendance certaine à vouloir limiter l'exonération du débiteur. Ce régime très favorable à la victime permet à l'obligation de sécurité de continuer à présenter un réel intérêt malgré la multiplication des régimes spéciaux d'indemnisation.

The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
