La préface indique : "En el año 2010, y aprovechando que la Comisión de Derecho Internacional había terminado su Proyecto de artículos en primera lectura (2009) sobre la responsabilidad de las Organizaciones internacionales, pretendí exponer clara, sistematizada y, en lo posible, crítica¬mente cual era el estado de la cuestión una vez que la Comisión tras haber aprobado, en el verano del 2001, su Proyecto de artículos sobre la responsabilidad del Estado por hechos internacionalmente ilícitos, había hecho lo propio con este otro. Me pareció entonces que sería útil reflexionar, y hacerlo ya, sobre lo que de común para Estados y Organizaciones tenía el Derecho Internacional de la Responsabilidad, así como llevar a cabo también dicha tarea respecto de las diferencias que en la regulación de esta cuestión se presentaban según que el autor del hecho ilícito fuese de una naturaleza (estatal) o de la otra. Era ya consciente, y así lo reflejé en mismo título del libro (La responsabilidad internacional de Estados y Organizaciones [Balance provisional de coincidencias y matices]), Murcia, 2010), de la provisiona¬lidad de sus páginas, pues en enero de 2011 la CDI había decidido afrontar la revisión, en segunda lectura, del texto aprobado en el verano de 2009. En el verano de 2011, la Comisión adopta el texto definitivo de su Proyecto y la Asamblea General de Naciones Unidas toma nota de él y lo incorpora a una de sus resoluciones, invitando a los Estados a que lo tengan en cuenta en su práctica. Este libro que hoy presento estudia cómo la Comisión ha concebido finalmente la responsabilidad de las Organizaciones internacionales según el Derecho internacional contemporáneo. Así, todo queda dispuesto para que, en su momento, pueda el autor del mismo cerrar sus publicaciones, que no su interés, sobre estas cuestiones con la edición de un Derecho Internacional de la Responsabilidad que atienda a estos importantes trabajos y a su influencia en la práctica de sus sujetos. Ya se ha iniciado esa tarea que llegado el día, y si el Buen Dios quiere, podrá ver la luz"

Conflicts between foreign investment law and environmental law are becoming increasingly frequent. On the one hand, the rise of environmental regulation poses significant challenges to foreign investors in several industries. On the other, the surge in investment arbitration proceedings is making States aware of the important litigation risks that may result from the adoption of environmental regulation. This study of the relationship between these two areas of law adopts both a policy and a practical perspective.
