Si la naissance et la construction du marché communautaire s'est d'abord centrée autour d'enjeux économiques et politiques, les institutions européennes ont progressivement ouvert leur champ d'activité pour y intégrer la santé publique et ainsi construire une « Europe de la santé ». L'effort d'harmonisation des politiques de santé des États membres a indubitablement généré certaines difficultés. Tel est le cas de l'ouverture du capital des pharmacies d'officines, profession de santé originale, alliant santé et économie. L'intégration de la santé dans l'Union européenne soulève déjà certaines problématiques, notamment à travers l'objectif d'homogénéisation du droit de la santé dans l'UE confronté au principe de subsidiarité, maintenant aux États Membres certaines de leurs prérogatives. Ensuite, et de façon plus particulière, la question du statut ambivalent du pharmacien, profession de santé et acteur économique, est révélatrice des obstacles auxquels se heurte la volonté de la Commission de libéraliser le secteur pharmaceutique, notamment en ce qui concerne a question de la propriété du capital des pharmacies d'officine aux seuls pharmaciens.

"Human tissue and biobank research is of increasing importance for understanding the causes of widespread diseases and developing effective therapies. However, while the success of biobank research depends on the availability of a large number of samples and the consolidation of collections across country borders is very desirable from the perspective of researchers, the legal and ethical requirements for the procurement, storage and use of human tissue samples are rather heterogeneous across different countries. Moreover, the lack of comprehensive supranational regulation on human tissue and biobanking can be seen as posing a serious threat to transnational biomedical research. Against this background, it was one of the aims of the EU-funded Tiss.EU project ('Evaluation of Legislation and Related Guidelines on the Procurement, Storage and Transfer of Human Tissues and Cells in the European Union--an Evidence-Based Impact Analysis') to analyse the ethical and legal regulation of human tissue and biobank research across the 27 European Member States plus Switzerland. The results of nine international workshops and three conferences are gathered in this volume. While the country reports evaluate the implementation of ethical and legal guidelines at a national level, point out their strengths and deficits, and, where required, create an evidence base for the revision of said legislation, the conference reports address more general ethical and legal issues in this field. Le terme promotion de la santé en Afrique, près de 30 ans après l'adoption de la Charte d'Ottawa, continue d'avoir des connotations complètement hors du sens que lui confère cette charte. Cela n'est pas étonnant quand on sait que la notion de santé dans ce contexte africain équivaut à la lutte contre la maladie à travers les soins de santé dispensés par des professionnels de la santé dans des formations sanitaires et les hôpitaux. L'évolution que connait le continent depuis quelques décennies est de donner un peu plus de place à la communauté à travers les relais communautaires dans une participation communautaire vidée de son contenu, car le pouvoir n'est jamais passé entre les mains des communautés.C'est au vu de tout ceci que le présent ouvrage à sa raison d'être pour expliquer les fondements de l'autonomisation communautaire et de la promotion de la santé avec leur importance pour la région africaine en proie aux mauvais indicateurs de santé comparativement aux autres régions du monde.
