Esta consideración inicial lleva al autor a plantearse la ordenación del litoral como una función pública diferenciada de la ordenación del territorio, cuando menos, en cuanto que, aquélla (la ordenación del litoral), alcanza tanto al espacio terrestre como marítimo, mientras ésta (la ordenación del territorio) se limita al espacio terrestre. Dado que la ordenación del litoral es una competencia asumida con carácter exclusivo por algunas CC.AA., entre ellas Andalucía, el autor aborda el estudio de la territorialización del mar, así como las amplias competencias asumidas por las comunidades litorales sobre el espacio marítimo. Dicha propuesta de gestión integrada toma como modelo de referencia la Recomendación 2002/413/CE, del Parlamento Europeo y del Consejo, sobre Gestión Integrada de Zonas Costeras, por la que se insta a los Estados miembros a la elaboración de estrategias nacionales; se trató de un primer paso, de un camino que ha seguido con el Protocolo para la Gestión Integrada de las Zonas Costeras del Mediterráneo y que, probablemente, culminará en los próximos meses con la aprobación de la Directiva Marco para la Planificación del Espacio Marítimo y la Gestión Integrada de las Zonas Costeras. Tanto la Recomendación como el Protocolo, son objeto de un estudio detenido y profundo, destacando, de este último, sus objetivos e instrumentos para la gestión integrada. En definitiva, el litoral es un espacio disputado entre la conservación y su uso con fines económicos, afectado, como ningún otro, por el cambio climático. Razones éstas que han provocado su presencia, una vez más y con un carácter prioritario, en la agenda política y legislativa: La Ley de puertos y marina mercante, la de protección y uso sostenible del litoral, la futura Directiva marco para la Planificación del Espacio Marítimo, las futuras Estrategias Marinas o los nuevos Planes hidrológicos son un ejemplo de lo afirmado.
