La mondialisation pose la question principale de la place de l'État dans l'architecture juridique de la communication audiovisuelle. La volonté de neutraliser le pouvoir normatif de l'État est exprimée en premier lieu par l'internalisation de la communication audiovisuelle par satellite, La thèse de la convergence technologique et la concentration des acteurs de la communication audiovisuelle et en deuxième lieu par la régulation internationale fondée sur une logique mercantile et libre-échangiste. La capacité de l'État se trouve ainsi diminuée, il perd toute légitimité et son pouvoir s'amenuise.Deux logiques guident ce travail de recherche, correspondant aux deux angles de la mondialisation de la communication audiovisuelle, d'une part les mutations technologiques, l'accentuation de la concentration économique dominée par le processus de déréglementation et de libéralisation, au profit des logiques de concurrence et de régulation marchande, d'autre part la régulation mondiale de la communication audiovisuelle et les accords de libre échange. L'axe d'étude retenu est l'analyse des conséquences juridiques des enjeux de la mondialisation de la communication audiovisuelle sur la souveraineté étatique. L'étude révèle que l'on assiste à un démantèlement des modalités nationales de régulation étatique et une disqualification de l'État ainsi qu'à l'émergence de nouveaux acteurs associés à l'élaboration des normes traditionnellement du ressort du pouvoir central de l'État. Cette mutation s'accompagne d'une réglementation de plus en plus élaborée au niveau international marquant ainsi son incapacité à donner un statut juridique particulier aux œuvres culturelles afin de préserver la souveraineté étatique en matière de communication audiovisuelle d'où l'élaboration d'un instrument normatif international.
