La imparcialidad de los magistrados del Tribunal Constitucional viene cuestionándose desde los distintos medios de comunicación con especial ahínco a raíz de las abstenciones de su presidenta y de su vicepresidente, seguidos de la recusación de cinco de sus magistrados. La tacha de politización, bronca televisiva incluida, y la anticipación pública del sentido de los votos en función de los intereses del partido proponente, han sido algunas de las ácidas críticas vertidas sobre los magistrados, y con ellas se ha puesto en entredicho su recto actuar, con el resultado de un descenso de la credibilidad de los ciudadanos en el proceder del máximo intérprete de la Constitución. En la presente monografía se realiza un exhaustivo análisis de la doctrina jurisprudencial del Pleno, Salas y Secciones del TC sobre el tratamiento que se ha hecho de la abstención y recusación de sus magistrados. La aplicación supletoria de la Ley Orgánica del Poder Judicial, tanto en cuanto a las causas como al procedimiento, tramitación, recursos y un largo etcétera, ponen de manifiesto el interés por conformar un Derecho procesal ad hoc para el Tribunal. Diferencias en la interpretación de las causas, cómputo de plazos, amplitud en la subsanación del poder y otros aspectos relativos a la aplicación y eficacia de las garantías que rodean su imparcialidad nos llevan en la misma dirección. La regulación de los instrumentos garantes de la imparcialidad, y la especial y no siempre motivada aplicación de la misma, suponen trabas importantes a superar si queremos que el derecho al juez imparcial sea eficaz y efectivo, en la misma medida, tanto en la jurisdicción ordinaria como en la constitucional y con ello hacer realidad la justicia como uno de los valores superiores del ordenamiento jurídico.
