En Espagne, la responsabilité objective comme système de base applicable à la responsabilité de l'Administration est reconnue depuis longue date et extensive à la responsabilité hospitalière ; l'application de cette règle de responsabilité sans faute s'est vue limitée récemment, entre autres, par la loi de 1992 sur la Procédure Administrative Commune, modifiée en 1999. En revanche en France, avant 1992 pour engager la responsabilité du service public hospitalier une faute lourde devait être prouvée. Désormais une faute de nature à engager la responsabilité suffit. De plus, depuis 1993 la responsabilité sans faute est reconnue par le Conseil d'Etat ; par la méthode comparative, nous constatons que les systèmes de responsabilité hospitalière français et espagnol convergent aujourd'hui : le durcissement du système espagnol converge avec l'assouplissement du système français. Au centre, on trouve la solidarité nationale pour faire face aux dommages disproportionnés sans lien avec l'état préalable du malade ; le monde hospitalier européen s'aménage, à cet égard la loi et la jurisprudence doivent garantir un équilibre entre sécurité juridique et flexibilité pour éviter l'avènement d'une médecine défensive "à l'américaine': Les lois française et espagnole votées en 2002 relatives aux droits des malades et à l'autonomie du patient témoignent l'intérêt des pouvoirs publics de s'adapter à cet aménagement.
