Fruit d’une analyse des différentes sources étatiques et non-étatiques du droit, cette thèse vise à renouveler la manière de concevoir la cession du contrat international au-delà des théories traditionnelles qui pensent le mécanisme en termes de transfert des contenus obligationnels du contrat. Cette thèse soutient que la cession du contrat international opère le transfert de la « position contractuelle » ou de la « qualité de partie au contrat », ce qui ne doit pas être confondu avec la qualité de créancier d’un droit de créance contractuelle ou avec celle de débiteur d’une obligation contractuelle. La cession de contrat international trouve son fondement dans le maintien du contrat international en dépit du changement des parties contractantes.La thèse est construite à partir de l’identification de trois crises du droit (la crise du contrat, la crise de la méthode conflictuelle, la crise de la loi étatique), et autour de trois changements de paradigme (de celui du contrat-échange à celui du contrat-relation, de celui de l’économie internationale à celui de l’économie globale et de celui du positivisme étatique à celui du pluralisme juridique). Les nouveaux paradigmes sur lesquels repose cette thèse nous ont permis d’exposer une représentation nouvelle de la cession du contrat international, de développer un régime du mécanisme à l’aide des méthodes du droit transnational des contrats, et de présenter une perspective différente sur ce que signifie le fait d’être partie dans un contrat international, ainsi que sur ce que cette situation implique à propos de la question du droit applicable et à propos du rôle de l’arbitre international.
