On Washington's Olympic Peninsula, at the entrance to Puget Sound, the Port Townsend of the 1850s was perfectly situated for sailing vessels. By 1880, thousands of ships from all over the world were passing through. Optimistic investors sought fortunes in shipping, logging, lumber mills, and land speculation. While commerce flourished at sea level, citizens built fine homes, churches, schools, clubs, a respectable shopping district, and parks uptown on the bluff. The settlers of this lovely seaport enjoyed rich cultural and social lives. Port Townsend went bust after the anticipated railroad failed to arrive. It remained largely frozen in time without economic motivation to tear down and replace its fine Victorian architecture. It wasn't until the 1970s that the beautiful setting and buildings were discovered by artists, hippies, preservationists, and, later, tourists and retirees. The town is now a thriving arts and cultural community, still beautiful, still small and remote.

This twelfth volume of The Papers of John Marshall concludes the first scholarly annotated edition of the correspondence and papers of the great statesman and jurist. In providing an accessible documentary record of Marshall's life and legal career, this collection has become an invaluable scholarly resource for the study of American law and the Constitution in their formative stages. Volume XII covers the final years of Marshall's life, from January 1831 to his death in July 1835. It also includes an addendum of documents (mostly letters) from 1783 to 1829 that came to light after publication of their appropriate chronological volumes. More of Marshall's correspondence survives from his last years than from any other period of his life. Nullification, the Cherokee cases, the bank bill, the election of 1832, the anti-Masonic movement, slavery, and African colonization are among the topics that prompted Marshall's comments and reflections. Family letters provide intimate details of Marshall's 1831 operation for the removal of bladder stones, his companionate marriage to "dearest Polly" (who died at the end of 1831), and his relationships with his children and grandchildren. Judicial opinions published here in full include Cherokee Nation v. Georgia (1831) and Worcester v. Georgia (1832). Major editorial notes set forth the background and circumstances of these celebrated cases.

The American Revolution radically changed the lives of many, some of them friends of the Revolution, some not, and some who wished to have no part of it for either side. Rarely did one of these reluctant witnesses leave a narrative journal. Nicholas Cresswell, a young English gentry farmer, was one. Arriving in Virginia during the momentous month of May 1774, Cresswell set out to seek his fortune as a farmer in the newer settlements in northwest Virginia. Soon the fortunes of Revolution overwhelmed him and his plans to begin a new life in America. For the next three years, Cresswell struggled to sustain his mission. Time was against him as his combatants on both sides, with increasingly ominous insistence, sought for and demanded his allegiance. This he never ceded. The very act of keeping a journal became dangerous. His written account of his attempt to sustain his liberty has long been a significant window into the turbulence of the Revolution. In offering this singular view of liberty during the Revolution, Nicholas Cresswell stood and still stands as a rebuke to subsequent historians of the Revolution, patriot leaning or loyalist leaning, who had difficulty in accommodating this journal into their generalized views of causation and justification. As a consequence, much of Cresswell's real perspectives were either lost or misinformed. In 1928, an edition of Cresswell's journal was published, but it was expurgated and not annotated. This edition of the Cresswell journal is the first unexpurgated and annotated edition ever published. As such, it offers new light for the better illumination of the turbulent world of revolutionary politics and personalities.

In 2000, the newly formed Thomas Jefferson Heritage Society asked a group of more than a dozen senior scholars from across the country to carefully examine all of the evidence for and against the allegations that Thomas Jefferson fathered one or more children by Sally Hemings, one of his slaves, and to issue a public report. In April 2001, after a year of study, the Scholars Commission issued the most detailed report to date on the issue. With but a single mild dissent, the views of the distinguished panel ranged from "serious skepticism" to a conviction that the allegation was "almost certainly false." This volume, edited by Scholars Commission Chairman Robert F. Turner, includes the "Final Report"—essentially a summary of arguments and conclusions—as it was released to the press on April 12, 2001. However, several of the statements of individual views—which collectively total several hundred carefully footnoted pages and constitute the bulk of the book—have been updated and expanded to reflect new insights or evidence since the report was initially released.
