Now, it is perfectly clear that the defendant is a person entitled to the protection of this statute, and to have the benefit of those provisions in it which relate to persons acting in pursuance of it, if he acted under it, and upon the subject-matter of it upon the occasion alluded to. But it is insisted, upon the part of the plaintiff, that he has only a particular power under that act, and that he was bound to convict the plaintii before he could commit him. With respect to this, there is no doubt that the defendant did exceed his jurisdiction in the way the Counsel for the plaintiff have contended; for the defendant had no right to arrest the plaintiff under the circumstances. He might have seized the plaintiff's goods, and, in the manner pointed out in the act, have acquired a right to commit him; but he does a ditferent thing-he took the defendant at once into custody, and so far exceeded his authority; and then comes the question, whether he has acted bond fide and in execution of the subject-matter in which he was authorised to act under the statute? The first consideration is, whether he had so far exceeded his duty as to disentitle himself to the directions which the learned Judge gave? Had he sufficient colour or reason for doing what he did? If he looked to the statute, he would see he had no power to do what he did; but he exceeded his authority in a matter in which he had jurisdiction. I think any Magistrate might easily make the same mistake, and the jury having found that he acted bond fide, the Court conceive, and I conceive, that he might reasonably make this mistake, and that the...
