Over the past two decades, legal thought and practice in Latin America have changed dramatically: new constitutions or constitutional reforms have consolidated democratic rule, fundamental innovations have been introduced in state institutions, social movements have turned to law to advance their causes, and processes of globalization have had profound effects on legal norms and practices. Law and Society in Latin America: A New Map offers the first systematic assessment by leading Latin American socio-legal scholars of the momentous transformations in the region. Through an interdisciplinary and comparative lens, contributors analyze the central advances and dilemmas of contemporary Latin American law. The present volume has been planned and prepared in meetings of the Research Committee for the Sociology of Law of the International Sociological Association at the initiative of its chairman, Renato Treves, who also took upon himself editorial responsibility. The first edition of the volume appeared in Italian under the title La socioZogia deZ diritto. ProbZemi e ricerche. It was published in Milano, August I966. What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

"El libro se concibió en la creencia de que el estudio sociológico del Derecho sobrepasa cualquier límite jurisdiccional. La Sociología del Derecho debería proporcionar las bases de un entendimiento de aquellas transformaciones del Derecho y la sociedad, que son más fundamentales que los particulares cambios jurídicos que ocurren en un ordenamiento concreto; debería proveer de una más amplia perspectiva, dentro de la cual un estudio jurídico comparativo pudiera reportar un rico conocimiento del contexto social del cambio jurídico. Al escribir el libro, impuse mi propio método de análisis sobre un amplio y disperso conjunto de materiales, y esbocé ciertas ideas teóricas propias, entre las que destacan una específica concepción de la naturaleza de la ideología, y, por ende, de la ideología jurídica. Dicha concepción se usa en el texto, para criticar la teoría marxista, para analizar las condiciones de aceptación popular del Derecho, para examinar algunos aspectos del profesionalismo jurídico, y especialmente para desarrollar una interpretación del papel de jueces y tribunales.
