In recent years an extensive range of new research has been revisiting the topic of the location of international business activities, from a variety of different perspectives and background interests. This work has been inspired in part by two apparently quite different but actually related contemporary trends: on the one hand, an emergence or revitalization of clusters of activities co-located in or around selected global city regions or fast growing metropolitan areas; and on the other hand, an increased global dispersion of activities conducted within the value chains managed or coordinated by many large multinational enterprises and their business partners. The former trend has given rise to discussions of how the elite of the cultural-cognitive economy of the 21st century (in Allen Scott's terminology) or the creative class (Richard Florida's term) are now being drawn or brought back to major urban centers; while the latter trend is associated with debates over outsourcing, and the economic and social consequences of shifts in the ownership and location of distinct nodes of value chains once production systems become more fragmented and the component parts of such systems become more geographically dispersed. An increased interest in the subject of international business location has been shown by scholars in Strategic Management, in Economic Geography, and in Regional Science, as well as in our own interdisciplinary field of International Business Studies. However, as is often the case in academic research communities, these bodies of scholarship have tended to develop at something of a distance from one another, each conversing internally more than they have with one another. Location of International Business Activities aims to promote a greater conversation between those interested in the topic of Location from various different backgrounds or starting points. This edited volume explores the question of the lawfulness under international law of economic activities in occupied territories from the perspectives of international law, EU law, and business and human rights. Providing a multi-level overview of relevant practices, policies and cases, the book is divided in three parts, each dealing with how different legal fields have come to grips with the challenges brought about by the question of the lawfulness under international law of economic activities in occupied territories. The first part includes contributions pertaining to the international law dimension of the question. It contains chapters on the conjunction between jus in bello, jus ad bellum and international human rights law in the context of exploitation of natural resources in territories under belligerent occupation; on third party obligations flowing from the application of occupation law in relation to natural resources exploitation; and on State practice with regards to trading with occupied territories. The second part focuses on EU law and contains contributions that assess the EU’s approach to occupied territories and the extent to which this approach comports with the EU’s obligations under international law; contributions providing an in-depth assessment of the case-law of the CJEU on occupied territories; as well as contributions pertaining to the political considerations that may influence the legal framing of questions pertaining to occupied territories. The final part focuses on the business and human rights perspective, with chapters on investment arbitration as a means for holding the occupant accountable for its conduct towards foreign investments and investors; on the role and impact of the soft law framework governing corporate activity (such as the UN Guiding Principles) on business involvement with occupied territories; as well as a final case study on the dispute involving Israeli football activity in settlements located in the OPT and the legal responsibility of FIFA in this regard. The European social sciences tend to absorb criticism of their approach and re-label it as a part of what the critique opposes; thus criticism of European social sciences by subaltern social sciences, their 'talking back,' has become a frequent line of reflection. The relabeling of the critique of the European approach as a critique from ‘Southern’ social sciences of ‘Western’ social sciences has in effect turned ‘Southern’ as well as ‘Western’ social sciences into competing contributors to the same ‘globalizing’ social sciences. Both are no longer arguing about the European approach to social sciences but about which social thought from which part of the globe should prevail. If the critique becomes a part of what it opposes, one might conclude that the European social sciences are very adaptable and capable of learning. One might, however, also raise the question whether there is anything wrong with the criticism of the European social sciences, or, for that matter, whether there is anything wrong with the European social sciences themselves. The contributions in this book discuss these questions from different angles: They revisit the mainstream critique of the European social sciences, and they suggest new arguments criticizing social science theories that may be found as often in the ‘Western’ as in the ‘Southern’ discourse.
