La libre circulation des marchandises est l’un, des précieux acquis de l’union européenne. Cet acquis à ouvert la porte aux importations parallèles, qui consiste à importer puis distribuer les médicaments d'un État membre dans un autre État membre, en dehors du réseau de distribution mis en place par le fabricant ou son distributeur agréé. Les importations parallèles ont pu se développer toutes ces années grâce à une juridiction favorable et des politiques de maîtrise des dépenses de santé différentes d’un État membre à un autre. Il est difficile de déterminer avec précision si les importations parallèles entravent la R&D de l’industrie pharmaceutique car le prix du médicament en d’autre terme les bénéfices des laboratoires pharmaceutiques est la résultante de l’interaction de plusieurs facteurs. De même il est difficile de savoir si les importations parallèles apportent un bénéfice pour les citoyens (prix administrés) et les organismes de santé (différence de prix absorbée en totalité où en partie par l’opérateur parallèle).
