Updated as of May 29, 2018 This final rule revises HUD's public and assisted housing program regulations to implement the upfront income verification (UIV) process and to require the use of HUD's Enterprise Income Verification (EIV) system by public housing agencies (PHAs), and multifamily housing owners and management agents (O/As), when verifying the employment and income of program participants at the time of all reexaminations or recertifications. Book Description
Affirmatively Furthering Fair Housing (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition) The Law Library presents the complete text of the Affirmatively Furthering Fair Housing (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition). Updated as of May 29, 2018 Through this final rule, HUD provides HUD program participants with an approach to more effectively and efficiently incorporate into their planning processes the duty to affirmatively further the purposes and policies of the Fair Housing Act, which is title VIII of the Civil Rights Act of 1968. The Fair Housing Act not only prohibits discrimination but, in conjunction with other statutes, directs HUD's program participants to take significant actions to overcome historic patterns of segregation, achieve truly balanced and integrated living patterns, promote fair housing choice, and foster inclusive communities that are free from discrimination. The approach to affirmatively furthering fair housing carried out by HUD program participants prior to this rule, which involved an analysis of impediments to fair housing choice and a certification that the program participant will affirmatively further fair housing, has not been as effective as originally envisioned. This rule refines the prior approach by replacing the analysis of impediments with a fair housing assessment that should better inform program participants' planning processes with a view toward better aiding HUD program participants to fulfill this statutory obligation. Manufactured Home Construction and Safety Standards (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition) The Law Library presents the complete text of the Manufactured Home Construction and Safety Standards (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition). Updated as of May 29, 2018 This rule amends the Federal Manufactured Home Construction and Safety Standards (the Construction and Safety Standards) by adopting certain recommendations made to HUD by the Manufactured Housing Consensus Committee (MHCC). As required by the National Manufactured Housing Construction and Safety Standards Act of 1974 (the Act), HUD published, in the Federal Register on December 1, 2004, the first group of recommendations submitted by MHCC to improve various aspects of the Construction and Safety Standards. HUD, in publishing MHCC's recommendations in the proposed rule, indicated its agreement with all but a few of MHCC's proposals, and most of the recommendations are included in the final rule. HUD has also identified in this final rule those MHCC proposals that were not accepted by HUD, returned to MHCC for further consideration, or modified by HUD in light of public comments received. Consolidated Plan Revisions and Updates (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition) The Law Library presents the complete text of the Consolidated Plan Revisions and Updates (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition). Updated as of May 29, 2018 This rule makes streamlining and clarifying changes to the consolidated plan regulations of state and local governments so that the plans are more results-oriented and useful to communities in assessing their own progress toward addressing the problems of low-income areas. The rule also eliminates obsolete and redundant provisions and makes other changes that conform these regulations to HUD's public housing regulations that govern the Public Housing Agency (PHA) Plan. A consolidated plan is a document that jurisdictions submit to HUD if they receive funding under any of HUD's Community Planning and Development formula grant programs. The consolidated plan also serves as the jurisdiction's planning document for the use of the funds received under these programs. Book Description
Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition) The Law Library presents the complete text of the Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity (US Department of Housing and Urban Development Regulation) (HUD) (2018 Edition). Updated as of May 29, 2018 Through this final rule, HUD implements policy to ensure that its core programs are open to all eligible individuals and families regardless of sexual orientation, gender identity, or marital status. This rule follows a January 24, 2011, proposed rule, which noted evidence suggesting that lesbian, gay, bisexual, and transgender (LGBT) individuals and families are being arbitrarily excluded from housing opportunities in the private sector. Such information was of special concern to HUD, which, as the Nation's housing agency, has the unique charge to promote the federal goal of providing decent housing and a suitable living environment for all. It is important not only that HUD ensure that its own programs do not involve discrimination against any individual or family otherwise eligible for HUD-assisted or -insured housing, but that its policies and programs serve as models for equal housing opportunity.
