Cook, Duke University "An interesting collection, generally representing the center of the gun-control debate, with considerable variation in focus, objectivity, and political realism." -Paul Blackman, retired pro-gun criminologist and advocate Gun litigation deserves a closer look amid the lessons learned from decades of legal action against the makers of asbestos, Agent Orange, silicone breast implants, and tobacco products, among others. Suing the Gun Industry collects the diverse and often conflicting opinions of an outstanding cast of specialists in law, public health, public policy, and criminology and distills them into a complete picture of the intricacies of gun litigation and its repercussions for gun control. Using multiple perspectives, Suing the Gun Industry scrutinizes legal action against the gun industry. Such a broad approach highlights the role of this litigation within two larger controversies: one over government efforts to reduce gun violence, and the other over the use of mass torts to regulate unpopular industries. Readers will find Suing the Gun Industry a timely and accessible picture of these complex and controversial issues. Contributors: Tom Baker Donald Braman Brannon P. Denning Tom Diaz Howard M. Book Description
This inspiring book, Lawyers, Guns, and Money by Carol X. Vinzant, recounts the heroic efforts of Tom McDermott, a lawyer and victim of the infamous Colin Ferguson rampage on the Long Island Railroad, to take on the gun industry. He is among the leaders of an innovative and promising strategy to circumvent the NRA's political power and courts constrained by interpretations of the Second Amendment. Through civil action he hits the gun companies where it hurts most: the bottom line. Making insurance difficult for manufacturers to get, he has helped reduce the number of cheap hand guns, "Saturday Night Specials," often used in crime. This is a riveting account of tragedy turned into action, and how the law can be used to defend victims rather than enrich corporations.

Book Description
A History of Civil Litigation: Political and Economic Perspectives, by Frank J. Vandall, studies the expansion of civil liability from 1466 to 1980, and the cessation of that growth in 1980. It evaluates the creation of tort causes of action during the period of 1400-1980. Re-evaluation and limitation of those developments from 1980, to the present, are specifically considered. The unique focus of the book is first, to argue that civil justice no longer rests on historic foundations, such as, precedent, fairness and impartiality, but has shifted to power and influence. Reform in the law (legislative, judicial, and regulatory) is today driven by financial interests, not precedent, not a neutral desire for fairness, and not to "make it better." It uses products, cases and policies for much of its argument. These policies can be summarized as a shift from a balanced playing field, negligence, to one that favors injured consumers. The strict liability foreshadowed by Judge Traynor, in Escola v. Coca Cola (1944), was not adopted until 1962, when Traynor wrote the majority opinion in Greenman v. Yuba Power Products for the California Supreme Court. Second, the book examines the role of persuasive non-governmental agencies, such as the American Law Institute, in reforming and shaping civil justice. Never has it been less true that we live under the rule of law. Congress, agencies and the courts make the law, but they are driven by those who have a large financial stake in the outcome. Today, those with power shape the character of products liability law, at every turn.

Book Description
McClurg (a gun-regulation supporter) and Denning (a gun-rights supporter) apply their decades of experience studying firearms policy and gun violence in this balanced, reader-friendly casebook addressing the contentious issues of guns in America. Through cases, problems, and provocative notes and questions, the book explores current federal and state gun laws, major constitutional cases, post-Heller Second Amendment litigation, modern self-defense rules such as Stand Your Ground laws, civil liability, gun laws in other countries, legal solutions to gun violence, and issues of guns and race, alienage, culture, and gender. "In Guns and the Law, Andrew Jay McClurg and Brannon P. Denning deliver a balanced and comprehensive account of gun law and policy in the United States. This is an admirable achievement, especially given that so much gun discourse fails to engage with, or even acknowledge, contrary arguments and evidence. McClurg and Denning's book not only conveys a great deal of historical, political, legal, and practical information, but operationalizes that information by providing a framework with which to understand and debate it. Guns and the Law will be a standard reference for scholars, students, and other interested readers--a welcome addition to an area of scholarship and discourse that desperately needs more voices like McClurg's and Denning's." -- Joseph Blocher, Professor at Duke University School of Law To listen to the authors discuss gun regulation vs. guns rights on the Un-Uninformed podcast, click here.
