These guidelines consist of eight recommendations to be considered when developing hate crime policy and training. The recommendations will assist local agency executives and their training coordinators to develop and deliver effective training. These guidelines are consistent with the principles that shaped the POST Cultural Awareness Training Program. The guidelines should be considered by the law enforcement executive before specific hate crime training objectives are developed. The guidelines are department-wide in nature and reflect the value-driven, top-down process that reflects successful responses to law enforcement's response to hate crime.

This manual was developed pursuant to legislative mandate codified in Penal Code Section 13519.6. The guidelines will assist members of local law enforcement agencies by enhancing their training concerning hate crimes. Additionally, the guidelines provide strategies for agencies to develop management programs that comply with the California Department of Justice policy, the reporting requirements of California Penal Code Section 13023, and the public information requirements of California Penal Code Section 13873. With California's increasingly diverse population, both religious and cultural in nature, law enforcement officers need to recognize the potential for hate crime violations. The effective enforcement of hate crime law requires a unique balance of investigative skills and sensitivity toward the victim(s). An agency's proactive policies and overall response, apart from the initial officer's response, are crucial to the credibility of law enforcement agencies within their communities. Finally, new training curriculum emphasizes the need for a two-tiered review of protocols as part of the hate crime reports. In addition, federal reporting requirements have been implemented in California, as reflected in the California Department of Justice Information Bulletin, No. 94-25-OMET, dated September 30, 1994. This bulletin states ". . . that each agency submit reports of hate crimes" on an annual basis. The guidelines and accompanying resource information provide a starting point for agency personnel to appropriate procedures and training for their communities.

This Brief provides a clearly outlined and accessible overview of the challenges in creating and enforcing hate crime legislation in the United States. As the author explains, while it is generally not controversial that hate crime behavior should be stopped, the question of how to do so effectively is complex. This volume begins with an introduction about defining hate crimes, and the history of hate crimes and hate crime legislation in the United States. The author shows arguments in favor of hate crime statutes, for example: hate crimes reach beyond their victims to members of the victims’ protected group and cohesion of society at large, and should therefore carry higher penalties.The author also shows arguments against hate crime statutes, for example that they sometimes contain enhanced penalties for certain specially protected groups and not others, and have a high potential for ambiguity and uneven enforcement. From a law enforcement perspective, the author explores the practical challenges in enforcing these statutes, and solutions to address them. Investigative techniques and resources vary significantly across police departments, as does training to identify and distinguish hate crimes from ordinary crimes. There is high potential for law enforcement and prosecutors’ personal biases to effect the classification of crimes as hate crimes.
