Opportunities and risks are twins. There are few to deny the opportunities of global networks in general and of the Internet in particular. But many fear for the concomitant risks, or what they perceive as a risk. Racist speech, pornography and personality profiling rank highest in public awareness. Some concerns are quasi universal, like child pornography. But for others there are at least differences of degree. Following its history, Germany has tabooed right wing publications. As a result of a lifetime of incomparably wide-ranging investigations, Aaron Wildavsky concluded that politics in the United States and elsewhere was a patterned activity, exhibiting recurring regularities. Political values, beliefs, and institutions were neither endlessly varied, nor haphazardly organized. They tended to exhibit a limited range of variation, and were organized in discoverable, predictable ways. In Cultural Analysis, the fourth collection of his essays posthumously published by Transaction, Wildavsky argues that American politics, public law, and public administration are the contested terrain of rival, inescapable political cultures.Analysts of American politics distinguish liberals from conservatives and Democrats from Republicans, but do not explain how these categories of political allegiance develop, maintain themselves, or change. Wildavsky offers a cultural-functional explanation for ideological and partisan coherence and realignment. Wildavsky also felt that these dualisms did not adequately capture the ideological and partisan variation he observed on the political landscape. Like others, he detected another recurring strain of political allegiance: that of classical liberalism or libertarianism. This book aims to contribute to our understanding of one of the most pressing issues of modern international law: the relationship between the international legal order on the one hand and the domestic legal orders of over 190 sovereign states on the other hand The traditional and dominant understanding of this relationship is that there exists a strict separation between the international legal order and domestic legal orders. Processes of legal globalisation and internationalisation have made this relationship much more complex. Legal authority has shifted away from the state in both vertical and horizontal directions. Forced by the pressures of interdependence, states have allowed international bodies to oversee and sometimes even implement and enforce domestic legislation. At the same time, private persons are more and more drawn into an internationalized order. Increasing cross-border flows of services, goods and capital, mobility, and communication have further undermined any stable notion of what is national and what is international. This book offers several partly complementary and partly competing perspectives that allow us understand and make sense of the complex interaction between the international and domestic sphere.
