This book explores an interdisciplinary field at the intersection of gender and development studies, disaster and land tenure policy. It is well known that women generally have weaker claims to land. But how does that translate to increased vulnerability during disaster? Using case studies from Asia, this book argues that land tenure is a key factor in mitigating the impact of disasters on women. The scale and frequency of disasters have been increasing in recent decades due to human impact on the landscape and climate. Unsustainable farming and land management systems have increased environmental risks and social vulnerabilities. However, around the world the costs of disasters are disproportionately borne by women, due largely to their reduced mobility and lack of control over assets. In post-disaster settings, women’s vulnerabilities increase due to gendered rescue and rehabilitation practices. As such, a gendered approach to land rights is critical to disaster preparedness and recovery.

This book explores the gendered dimensions of recent land governance transformations across the globe in the wake of unprecedented pressures on land and natural resources. These complex contemporary forces are reconfiguring livelihoods and impacting women’s positions, their tenure security and well-being, and that of their families. Bringing together fourteen empirical community case studies from around the world, the book examines governance transformations of land and land-based resources resulting from four major processes of tenure change: commercial land based investments, the formalization of customary tenure, the privatization of communal lands, and post-conflict resettlement and redistribution reforms. Drawing from field research in Cameroon, Ghana, Vietnam, and the Amazon forests of Brazil, Bolivia, and Peru, this book explores the relationship between gender and land, revealing the workings of global capital and of people's responses to it. A central theme is the people's resistance to global forces, frequently through an insistence on the uniqueness of their livelihoods. For instance, in the Amazon, the focus is on the social movements that have emerged in the context of struggles over land rights concerning the extraction of Brazil nuts and babacu kernels in an increasingly globalised market. In Vietnam, the process of 'de-collectivising' rights to land is examined with a view to understand how gender and other social differences are reworked in a market economy. The book addresses a gap in the literature on land tenure and gender in developing countries. It raises new questions about the process of globalisation, particularly about who the actors are (local people, the state, NGOs, multinational companies) and the shifting relations amongst them. Within discussions of land and resource rights, there is growing attention to women’s rights, mostly in terms of household and individual rights to private property. This leaves unanswered questions about whether and how women’s land rights can be secured under collective tenure, upon which billions of people worldwide depend. There is an important gap in conceptual tools, empirical understanding, and policy recommendations on women’s land rights within collective tenure. To address this gap and lay the foundations for a sound body of empirical studies and appropriate policies, we develop a conceptual framework to improve understanding of women’s land rights under collective tenure. We begin by discussing what secure tenure for women on collective lands would entail. We then present the conceptual framework for what factors would affect women’s tenure security, building on a framework for land tenure security that focuses on individual and household tenure. We give attention to particularities of rangelands, forests, and other types of lands as well as commonalities across types of collective lands. A key theme that emerges is that for women to have secure tenure under collective tenure, two dimensions must be in place. First, the collective (group) itself must have tenure security. Second, the women must have secure rights within this collective. The latter requires us to consider the governance structures, how men and women access and control land, and the extent to which women have voice and power within the collective. More consistent analyses of collective tenure systems using the framework presented in this paper can help to identify which action resources are important for groups to secure rights to collective lands, and for women to advocate for their rights within the group.
